For NC, the spouse that committed adultery has no rights to alimony. Flirting with women or going on dates is not adultery by NC law definition.

North Carolina is a no fault state, and based on case law in North Carolina the fact you were married for 3.5 years makes her argument for alimony unlikely. Usually alimony is five years or more. Does she have her own income and how much of a gap compared to what you make? Do you have children together? I am also in NC and my attorney said it’s very unlikely she would get alimony and we also were married for 3.5 years.

If you live in NC you live in one of the few states that alienation of affection is punishable. If she had sex and admitted it. That’s criminal conversation in civil family court. Both are relevant with proof and can be used as leverage to settle if she pulls the alimony card. There’s a NC General Statute you should look up.

Split your money and get out.

I’m not sure about NC law. But get out and stay out. She doesn’t care about you anymore (she may never have)…it took me a couple years and an extremely traumatic divorce trial to see she never ever cared about me. It’s hard to accept, as until the trial, I assumed at one time she had to have, but that was one of those assumptions.

You should be good. If anything maybe a year of spousal support for a very small amount just based on pay gap.

Best thing to do is get with a lawyer and see where you stand. Be thankful you didn't have kids with her.

I think you'll come out of this fairly unscathed.

In most states, you generally have to be married 10 or more years for alimony to be considered.

Do you possibly live in an at-fault state? If so, that may be a problem.

Whatever outcome you choose, counseling is highly recommended to get back into a good place.
