Not yet in trial, but headed that way. Any way to ensure she loses the house? She's hiding the fact that she can move to her parents house and also take their car. Unfortunately deceased, her parents house and vehicle are now available and paid for free and clear. Her siblings have no interest, but i cannot prove it at this time. I'd need her text conversations for that. Anyways, if she were to stay there a night or a few nights or a week, with or without the kids, would that influence anything in the eyes of the court awarding me the marital house? She's taken a martial vehicle and parked it at her parents house, and has been driving her mom's vehicle. By nature if doing that has she commingled the martial and inherited property? I don't want any of her inheritance, I want the marital home and for her to take ownership and utilize her inherited property. Both homes are equal in capacity for housing the kids and similar size etc. Please share any ideas on how to insinuate commingling property and convincing the court that it'd be better for all of us and the kids included if she lived there and i stayed home.
