As I understand, and am experiencing, going scorched earth is the de facto strategy advised by many attorneys for wives these days. Get a common AGREEMENT with your attorney as to what’s fair and what they will fight with you for. Welcome to the Silver Bullet club as well, glad the first volley of (insidious, anti-family) ammunition did not trip you up. Many of us don’t fare as well (6 month protective order extension in my case). Fighting with you, and looking forward to seeing you succeed.

Status quo is the greatest bias of the court. The state you live in dictates how much of an uphill battle you'll have.

Her getting half the marital assets and liabilities is normal and expected. In terms of your pension, there are specific requirements around the length of your marriage. You can look it up online.

Spousal support is highly dependent upon your state. My state has no official spousal support statues, though my courthouse has a standard of 1/3 the duration of the marriage for the non-monied spouse. The longer you've been married, the longer you pay alimony.

First off, I hate that you’re going through this. I have.. it was nasty.. bunch of false claims.. proven wrong, and I won, so maybe I can help..

Did you get married in a community property, or equitable division state?

Do you still live in that state?

How long have you been legally married?

What’s the difference in pay?

Have either of you filed for divorce, if so who? Have you done a mediation? Do you have a trial date?

They are going to look at the growth of your assets from the date of the marriage. Depending on the state, alimony only kicks in after 7 years or longer. So if you’re less than that you might be good.

Need more info on the “injunction”. Was it an ex parte order or did you have to spend the night in jail, anything broken, holes in the wall, etc.?

The only real way out, if you’re the breadwinner and you’re not in a community property state, is to show the court it’s her fault and portray she’s unfit to be a mother..

If she made false allegations, vacate the order and put it in your divorce decree that she is puting you through vexatious litigation under false claims in an attempt to extort you. In your discovery, you need to provide all text, recordings of everything from cuss words she’s ever said to you, items broken in the house, any physical acts she’s done to you via text or record her (its not entrapment). If you can gaslight her until you get a reaction to show her true colors.

If you can prove cheating or her abusing you, verbal or physical, you have a chance. If you’ve done ANY domestic violence, she’s got you by the balls.

A sneaky option..

If neither of you have filed, call all the lawyers in your area and get a consultation, they wont be able to represent her if they’ve talked to you.. or at least consult with the best..

You can do other things like fire your lawyer 35 days before trial and motion for a continuance. You start over, but it will make her more eager to get it done and settle for less.
