I don't think sending mothers to jail is a vsiable(sic) solution, because I think it will only succeed in compromising the potential for a child's healthy upbringing.

In what way is a child benefited by being raised by a sociopathic liar? If the best interest of the child is really the goal of the courts, then paternity fraud should be vigorously prosecuted, and conviction should be an automatic loss of custody. Jail them like you would any con artist, and either put the child in the real father's custody, or that man cannot be found up for adoption.

One question is the actual rate of paternity fraud. Even if it's rare it's still important to address. But I've never seen any definitive answer as to how common it is.

I've seen the stat where ~10% of children are biologically unrelated to their father. But a lot of those fathers are aware of it. Things like adoption play into that.

The issue of welfare isn't that women are purposefully putting down the wrong father though. In a lot of states it's a required field because they want the father to pay back some of the welfare that's being paid out to the mother.

Which of course I think is kind of dumb from a left wing perspective.

But a lot of these mothers make up random names to put on the form. And what happens is sometimes those are real people and then the state goes after them.

One case I remember seeing was a mother who put down a close friend as the father because he was the "closest thing to a father figure" that the child had. But all he did was babysit and help out on occasion. He never pretended to be the father and he wasn't romantically involved with the mother. It just made sense in her mind when she was filling out the paperwork to put him down.

Well he started getting orders to pay child support. And both him and the mother have been in court together, on the same side, trying to make it so he doesn't have to pay child support because he's legitimately not the father. But the state doesn't care. He's on a form somewhere, by accident, and has no legal recourse even though the mother is on his side.

I think women who commit paternity fraud should be liable for civil action. In cases wherein only financial harm was done, make them pay back the money with interest. In cases where emotional damage is done (i.e. duping a guy into raising your child, because he thinks its his own) emotional damages should be paid on top of any financial investments he made for the child.

It took that poor guy 26 years to get the courts to leave him alone. Hope he sues.

No consequences for paternity fraud is sickening which is why I think they should be sent to jail for however long once their child is 18 though gotta love how being a mother is a much bigger reason to keep someone out of jail than being a father

Oh and possibly financial reparations to the defrauded party if they seek it

The idea of the paternity test ban in France is more subtle than what you think.

The idea is that nobody can make a medical procedure on someone without their consent or the consent of the people responsible for them, unless there is some level of urgency involved.

Which means that without the agreement of both parents, a paternity test can not be made.

It is a rather reasonable position when it comes to individual rights. You wouldn't want someone forcing medical procedure on you. And you wouldn't want one of the parent to be able to make unilateral decisions regarding the child's health. If one parent wants to tattoo a child, or circumcise it, and the other doesn't, then of course you would find such a regulation legitimate.

So it is not just as easy as you would like to think.

France can have paternity tests ordered by a court and with consent.
