There are cases of women stealing sperm to get pregnant and successfully suing for child support, the courts understanding the sperm was taken without the man’s consent. (Their view being once it leaves the man’s body, it’s no longer his, though he’s still responsible).

So, while I’m no lawyer and laws can vary from state to state, I’d say the precedents thus far do not favor men. Men should take steps to ensure their sperm doesn’t cause a pregnancy against their will.

While I’ve never experienced spermjacking, I have personally experienced a girlfriend who lied about birth control use in an attempt to get pregnant and experienced an attempted fake pregnancy scam. A vasectomy is the best value “insurance” I’ve ever gotten.

Please check with actual lawyer about this. Depending on what your local laws are, you may be able to charge her in some fashion. You should also talk to your local police and file a report immediately. Make copies of the video, give one to a lawyer, and one to the police and keep one for yourself and another copy on a cloud storage. Whatever you thought this relationship was, you are not on the same page as this chick. Even if she is not up to something shady, that behavior is still weird af and you should step away from that.

Two things, to some people saying this is not real, look up court cases of women impregnating themselves with condoms. It happens all the time, this case is particularly stupid and probably won’t works, but it does happen.

Second, contrary to what people are saying do NOT just cut her off cold. Wait until you confirm she is not pregnant! Once your sure she isn’t pregnant, then cut her off immediately. If not she may try to fuck with you because you broke it off with her. This is something that has probably happened to every man over 20 in one way or another. Where she will try to entrap you, by pretending to be pregnant.

Not in most jurisdictions. I mean maybe you could go after her civilly for something, but that won't get you out from being the legal father and responsible for child support.

In general, most jurisdictions, if you're biodad, you're legally father, and responsible for child support or raising the kid or whatever. Generally the only exception is if the sperm went via licensed physician as sperm donation, and you're not married to her.

That's pretty much it. So, yeah if you leave that used condom around, and don't make sure she gets to the contents, or whatever, generally you're going to be legally the father.

Oh, also, if you're married, and she gets pregnant, you'll legally be presumed to be the father. In order for that to not be the case you'd need to challenge paternity and in reasonably timely manner - wait too long and it's too late to change that, regardless of who's biodaddy.

And part 'o that whole mess is it ain't the kids fault, so in general the laws/courts aren't going to punish the kid over who is/isn't legally the father and legally responsible (and also has associated parental legal rights). I also suspect a whole lot 'o the time the courts and such really don't want to get into how the sperm got from whomever to her. If it wasn't through licensed physician as donated sperm, they're generally going to presume it got there the old fashioned way, or somebody may also be doing that - so no, you can't, e.g. craft your own written (attempt at) a legal agreement, sell or donate the sperm for a donation, and have it legally work that way.

So in general:

hubby is presumed legally father, unless not biodad and challenged in sufficiently timely manner (notably 'cause challenging it too late will really royally f*ck over the kid's life, and that's not at all fair to the kid, regardless what a sh*t the mom might happen to be),
and if she's unmarried, biodad is presumed to be the father, unless sperm donation happened via licensed physician and as a donation (e.g. it was done via a legitimate sperm bank for donation).

Will vary by jurisdiction, but the above is how it is, at least approximately, in most or all of the US. Most other Western (so called) civilized nations/countries/states do roughly similar ... ish, though it may vary significantly. Other places in the world, all bets are probably off, and probably best to well consult lawyer/attorney/solicitor/witchdoctor, or whatever governing local authority(/ies)/experts would be applicable.
