What's your opinion on the relationships between intoxication and consent? specifically, I would like to know whether you think a crime is committed in these situations, and by who:

  • willing sober man has sex with willing sober woman

  • willing-while-drunk man has sex with willing sober woman

  • sober man has sex with willing-while-drunk woman

  • willing-while-drunk man has sex with willing-while-drunk woman

These are the definition of the terms so we don't get in an unending debate on how the situations are to be framed:

  • 'willing' means that if someone were to stop time and ask them in a safe environment whether they really want to have sex with the person in question, they'd answer in the affirmative

  • 'drunk' means intoxicated to a level of mental and physical impairment that still allows autonomous movement and coherent speech, albeit at a perceptibly reduced efficiency. Passed-out people are not included in this scenario.

  • 'willing-while-drunk' means that if someone were to stop time and ask them in a safe environment whether they really want to have sex with the person in question, they would answer in the affirmative. There is not specification whether later, after getting sober, they'll regret their actions or not; feel free to discuss this possibility if you feel the need.

  • 'have sex with' means a sexual encounter that includes PIV sex. There is no specification of who does what i.e. we don't know who's exerting most of the effort or taking the lead; feel free to discuss various roles if you feel the need.
