My two cents: The honest answer is, up until now and even now they were mostly helping women. Human beings evolved as a gynocentric society where the lives of women and their care is more important and men are generally more expandable. This also helps with the survival of the fittest and better gene propagation. Where only one man is needed to reproduce. This is the reason why all of us have ancestors that are about 67% female and 33% male. Evolutionary speaking, not all men were supposed to breed. This is also the reason why women evolved to be better caregivers and more compassionate while men evolved to be better protectors and would generally put themselves in harm to save women.

However, now since we are moving away from traditional roles and practicing more monogamy, the laws are becoming more of a hindrance.

Why not a big push to change the divorce laws:

Because fighting in divorce court over scraps benefits lawyers who win big.

Men who really are rich and powerful couldn't give a damn about the divorce laws.

Jeff Bezos for example... if he'd really wanted to, he could have put all of that money in overseas accounts and trust funds and he had the money for a court battle. He paid his ex wife because he knew that the money he gave to MacKenzie, he'd make back very easily. He honestly didn't care.

Some wealthy men not quite at that level still can hide their money.

The average guy can't. And the law doesn't give a flying fuck about the average man or woman and neither does society.

My parents had a good male friend they took in after a divorce. He bought his ex wife out of the house and paid child support. He still lost his house and had to fight the government every step of the way for it. Why? Because his ex wife's lawyer was a self righteous asshole who decided his client was entitled to it and who wanted to increase his paycheck, despite the ex wife outright telling the court she had been bought out and wanted nothing to do with the house (I asked my dad if it was his ex wife's doing, and my dad specifically told me that and that the court went ahead with seizing the house anyway.) He eventually did get his house back, but it was a very very fierce fight.

Also, I had a male friend who married a Japanese lady and then got divorced. Japan doesn't support international custody of kids and they almost always support sole custody to one parent which, because he was a foreigner and his ex wife was not an absolute nutcase, the court automatically awarded full custody of their kids to his ex wife and her parents, and he only saw them 2－3 times in the ten years since.

In the case of Japan, the people there who support this do so because they believe sole custody is best, and they believe kids are best with the Japanese parent. These people usually more support traditional Japanese culture.

Hot take: a HVM is aware and accepting of the lifetime responsibility associated with long term commitment (marriage) and it doesn’t scare him away. That’s part of what makes him a HVM

Divorce laws were meant to protect women and children. There was no legal gay marriage back during the creation. Also, many women didn't work outside the home. The laws work well as they are for traditional marriages. They should just make separate laws for alternative lifestyles.

Alimony is only awarded in extremely rare cases nowadays, and the splitting of assets generally only covers those acquired as joint property during the marriage. How is this unfair?

Maybe we should get rid of existing laws and create a "pick a prenup" system so couples have to choose the most fitting option when they get married?

I personally am fine with prenups but at the moment some people see it as taboo to think about the "what will we do if we split up" when you are about to declare to each other you'll stay together forever.

Also many people still stay happily together without the formal legalities of marriage. So I wouldn't say no marriage equals being single forever.

From my observation this is out an outdated idea. Alimony is very rarely awarded now, and if it is, it is temporary. Splitting assets acquired during the marriage, sure, but that is simply fair and reasonable.

Divorce laws are only one component.

But even if we look at divorce laws themselves - why is it, that divorce laws keep moving in this direction. Year after year, decade after decade?
