So I’m not sure how much background I should post so skip to the **** is you don’t care.
Wife cheated and decided she doesn’t want to act like a married couple - won’t sacrifice for my happiness and I’m done being the scape goat. Nothing super bad just not husband and wife anymore.(goes out won’t tell me who with blah blah blah, probably still cheating-IL so no fault divorce etc)
4 kids+married 10 years. I’ll have to pay child support+ alimony sooooo
We are comming to a verbal agreement but not getting a divorce bc she would then be off my health insurance. Plus she thinks there is a chance to fix it or something but current behaviors are a no go for me. I’m not trying to be petty or mean in the divorce and basically if I can keep 100% of my retirement, truck, tools for work and dirt bike- idc about the rest (house 4 wheeler, lawn mower, all our furniture and appliances.)
We own a corporation together but it’s brand new so not much value other then the tax advantages.
I have a good job but it pays a lot sometimes or I’m laid off- so trying to keep my “required payments” low with the agreement if the kids need anything extra I’ll just pay for it.
**Skip to here if background is unimportant***
Is a legal separation just like a divorce except: she stays on my health insurance? Or Could she come back and get more if we later get full divorced after she gets health insurance somewhere else?
P.s she doesn’t know I plan to make it official with a lawyer after we agree to terms. She thinks we will just do all of this on a handshake. So I may get blow back from that.

Depends on the state. In my home state, a legal separation is essentially a type of divorce. Custody, property, assets, etc are settled and a decree of separate maintenance is issued. The terms of the settlement agreement can be applied to the eventual divorce. There's actually a language in my agreement that covers this. For me a legal separation seemed like a good idea because the ex wanted to stay on my health insurance and the state requires a very lengthy separation (18 months!) for a no fault divorce. I'm about 9 months in to the legal separation and it's been almost year since she nuked the marriage. If had to do over I would've pushed harder for an actual divorce. Mostly for the closure, but also because I'm finding that some women won't enter a serious relationship with or even date a separated man.
Oh and make sure your insurance will actually carry a legally separated spouse before you get too far along in the process.
