This was technically an act of common law arson.

He'll be guilty if the prosecution can show that he did not possess the house. However, someone smarter than me may be able to shed some light on whether or not a mortgage implies that he does not have possession of the property, technically speaking.

a mortgage is an encumbrance (limitation) on the right to the property just as an easement would be, but because most mortgages occur as a condition for new loan money, the word mortgage has become the generic term for a loan secured by such real property.

This is just as petty as a woman destroying things in response to a relationship ending, something I've seen this subreddit call out more than once. Blindly supporting destructive behaviour just because the destructive party is male is hypocritical.

edit: Complaints of women getting off on charges when they've destroyed things are reasonable, when I posted this the top comment was saying

Well, perhaps its because he decided to set shit on fire rather than simply destroy it?

Setting fire to your home endangers the neighbors pretty well, and the article says they are holding him for arson.

Downvoted for misleading title. He was arrested for setting fire to his own property, which is arson whether or not the property is his.

If he had simply trashed his place there would be no arrest.

Assuming that his fire didn't affect any nearby structures, this seems like an open and shut case of not arson.

The Common Law definition of arson has four elements.

1) The malicious 2) burning 3) of the dwelling 4) of another

If it went differently the fire could have consumed the house and spread to other houses, thus causing a danger to the community.

Technically if there was a loan on the house it's not his. But seein as there was the spray painted suv in here the other day they shouldn't be charging him.

The problem with this is all in the method. He used a fire, which had the risk of spreading to other properties and causing collateral damage to the neighborhood.

Now, had he hired a bulldozer or a backhoe and just physically wrecked the place with that, then the cops would not have had a leg to stand on and he could have tore down his home with impunity.

This is not the kind of person we want to be defending. He was arrested for arson, not destroying his property. Also he seems unstable, just because a couple is going through a divorce doesn't mean the woman is at fault or going to take everything. This guy seems unstable and from just the information at hand I can't blame her for wanting to leave him.

What I hate about this, is anytime there is a woman and man incident, is the man's picture is posted as the first thing you see. Rarely do I see a picture of a woman's mugshot when they do something bad. They do, on occasion, post the picture, but there is this "protect the woman" crap all over the place. Scumbag is a scumbag. That favoritism is incredible.
