The article itself is incredibly biased. It makes the assumption without providing evidence that the men that used this argument had no basis for it even though a judge and jury agreed that there was a basis. It was written with an anti-male agenda with no effort to objectively present the facts.

As far as I can tell, the law is being used exactly as it was intended. To prevent people from serving life in prison when there isn't enough evidence to prove self defense beyond a reasonable doubt, but there is a preponderance of evidence.

Calls for legislative change began in 2010 after an outcry over the case of Luke Middendorp, who was jailed for 12 years with a minimum of eight for defensive homicide.

Middendorp, who was on bail and had previously assaulted his former de facto wife, Jade Bownds, stabbed her to death after an argument in which he claimed she threatened him with a knife.

The first woman convicted of defensive homicide by a jury, Eileen Creamer, was sentenced last year to 11 years' jail with a minimum of seven.

Creamer said she stabbed and bashed her husband because he bashed her and demanded kinky sex.

That's interesting. The first one seems to be a claim that the man took a knife from his wife, who threatened him with it, and stabbed her. He receives 8-12 years.

The second is a wife who was hit, and gets a knife somewhere else? 7-11 years. I admit I don't know all of the facts of course.

Assuming the author of this article believes these two claims to be true. How on earth is the male example a misuse of the law? It sounds exactly like what it was meant to be. They both were threatened and both committed murder.

I've never heard of this law. From what I've read, it seems like it lets people off with excessive force if you feel like your life is in danger.

If that's true, I can think of no reason why it should only apply to women.

It seems to be related to battered woman syndrome, which is supposedly gender blind, as a man successfully pleaded it in 2003, and got a lighter sentence for killing his wife after she had been emotionally abusing him for months. However, I doubt it would have been so successful if the man hadn't had a learning disability.

Apparently so are the people who framed it.

The solution is presumably going to be some gender neutral restriction like you must be shorter than your victim, or weigh less or have fewer penises than your victim.

Uhhh, that was its original intent.

The commission had recommended the change to prevent unreasonable murder convictions of women who killed after years of domestic violence or abuse, but who had not faced an immediate threat to their lives.

If there is no immediate threat to their lives, killing the man is not in self defense, unreasonable and therefore should be considered murder.

These cases went to trial and the law was applied evenly.

Feminists hate it when the truth comes out about the voilent and abusive nature of women, especially when they have a man captive to the preditory nature of the divorce industry.

When they first opened womens shelters in the US surprisingly the rate of male homicide fell.

This was because rather than kill their husband, women had a place to go....because they were going to kill him....their husband....the one truley living with the enemy.

It seems that men and women are equal with regard to violence, I don't say men can't be violent, but women are just as violent and most "violence" is the result of us all being "humans". And humans can be dangerous.
