This is a difficult case. The origin of the rumour is unknown, so we cannot blame Garcia for planting the idea in his mind (as Tracy Denise Roberson did).

She did, however, choose to lie about the rape being true rather the continue to deny it along with (presumably) Torres. It was a self-serving act that she knew would seal the fate of Torres but may allow her to survive. Rodriguez was waving a gun and proved to be murderous so anything she said in fear could certainly be excused, but she will get no extra sympathy from me.

Oh, and Roberson? She was convicted of involuntary manslaughter - justly so.

Downvoted for misleading title. He heard the rumour elsewhere, kidnapped the guy, and then confronted her with the other guy tied up, waving a gun around, demanding "the truth" from one of them.

She may have been in fear for her life, or just trying to say yes so that the ordeal would be over, hoping he'd let them both go.

This is not a good poster child for false rape accusation. For rape hysteria, yes, but not false accusation, not when people were in peril.
