I wish could remember the link to "Best Restraining Violation Ever" which happened when a man's ex visited him in jail and then complained that he violated the restraining order she had against him.

And yes, he was found to have violated the restraining order.

They should make it a rule that if someone who has an order against someone is the one who "violates" it, that the order be instantly null & void. Like going to dad's house to drop off the kids. Use a mediator of sorts as a go-between to maintain the no-contact. Another example is say you see dad across the field, he's the required distance away. If mom runs over to them and cries foul, well, it's her fault he's too close then and that should invalidate the order.

When I got a restraining order against my creepy ex-roomate they told me that I would be arrested if I tried to contact him. They try to avoid this sort of scenario. I highly doubt he was the only one who got in trouble.

I was in Court when a man was brought up on DV charges because when his gf attacked him he ran away from her. While chasing him she fell down and injured herself and he was charged with 'causing' the injury. The facts were not in dispute, they actually charged him and he plead guilty. I talked to him in the hallway about why he did not fight the case and he said his lawyer told him that under the law he was technically guilty and may go to jail if he did not plead.
