the question is not so simple; depends on the type of business structure. if we're talking sole proprietorship where the business is not its own separate legal entity, then the business' debt is personal debt and joint marital property which is included in the process of property division. that means upon divorce the starting point is business assets and debts are split 50/50 between spouses. so yeah, the wife would be liable for 50% of the debt whilst enjoying 50% of the assets lest they negotiate or a court says otherwise.

if the business is a limited company or a limited liability partnership then not even the husband is personally liable (except in limited circumstances) for its debt so the wife wouldn't be either.

You are confusing personal debt with the debt of a business entity. The first is split 50/50, the other stays in the business entity.

Depends on the state. In NH everything is split 50/50 including debts. Friend didn't lose anything in the divorce because if she went after him he'd go to court and she'd get 50% of his debt so it was in her best interest to let him keep his car and such.

I'm pretty sure in every state that debt is split evenly regardless of whether it is a private company or individually held.

But if it's a public company like Elon musk's company, everybody who has stock in that company owns it.

You also have to take into account their arrangement. Did they agree that he would make the money and she would raise the children? In that case, both have given up something in the partnership.

When they divorce, she is now stuck having to make her own income again without having been in the workforce or improving her skills this whole time because she was working for the family.

Anything that woman should get nothing in a case like this, to me, seems very unjust.

The debt is a bit trickier, but it's still the case that the man in this case would have spent his time building a career and making the business decisions, while his wife really can't do that.

I knew a guy like this that divorced his wife, thing is there was a ton of CC debt that they both had a part in creating. Divorce was more splitting the debt more than getting anything.
