In what way? 529s are a marital asset, and will end up on one parent's balance sheet. Because the parent that ends up with it after divorce has complete control of the account, including draining it dry.

Not a good bargaining chip unless alimony has been ordered. You don't bargain for something you may not have to pay, better try to get 70:30 asset split in your favor, then ask your kids to repay college tuition

Sort of. I'm going after compensation retroactively for the college/expenses I've paid to date and before his 21st (my state). It's part of the divorce since it's not future costs (ie child support).

In my state child support goes until the kid is 23 years old if they go to college. So the way I look at it is the $15k I’ll be paying for the next 20 years better fucking go towards a college fund. Already told my STBXW I don’t have the money to fund their education after paying all this CS.

I did exactly this. In lieu of alimony I agreed to fully fund my kids’ 529 college savings accounts thru their junior year in college, and also pay for their health insurance until age 26 or they are employed and can obtain their own. The terms are spelled out in our divorce agreement. I was satisfied knowing that my money was going to the kids instead of my ex. She was satisfied because it took the pressure off her to save for their college (she was never very disciplined to save anyway). It was also a sure thing from here POV, because alimony was never a guarantee.
