Hey Gentlemen, As a resident in Buffalo,NY I am learning that the laws are tricky in this state regarding marriage. In 5 days, we have a mediation scheduled to draft a separation agreement. After 6 months in NY, she promises not to file for divorce... I'm consulting with two separate attorneys to maximize legal guidance. She wants an amicable separation & is being pretty peaceful about the whole process - for now...

We rent our home, have very few assets & two amazing children. I own my vehicle & she leases hers. I'm level headed, do not drink or smoke & am an excellent father. She is going to ask for 60/40 custody, but I am going to insist on 50/50 custody. The goal is to not make this messy, expensive or complicated.

Marriage counseling did not work & we are both seeing our own therapists. The kids do not know about her choice to leave me yet. She was having an affair & I'm deeply devastated by this separation. We have agreed to March 15th as my move out date. The reason for this date is that I will need time to save up enough money for a security deposit & furnishing the new rental house.
