Refuse alimony if you can. You don't need to offer her any alimony. Division of assets is tough but I believe alimony and cs is worse because it's on going

She wants 6O% so she can get the child support, plain and simple. Just make sure you do a realistic budget to see what you can afford to rent. If you can cut down expenses now…. Like depending on how much it is. Life insurance can be expensive. Not saying get rid of it, but reduce it. Just analyze every expense.

Do NOT move out without a written and agreed to custody schedule. If the kids stay with her - she has de facto control over the custody schedule until the divorce is finalized. Guess what she’s going to do - turn you into an every other weekend dad and tell the Courts - see this is the status quo - I am the primary parent. There was another post here a couple of days about how someone was a primary parent, moved out of the home and then the ex controlled the schedule and made herself the primary parent by not letting the dad take the kids.

Tell your lawyer 50:50 is a hill you will die on.

75% of interactions will happen between your lawyer and her lawyer without you. You need to make sure your lawyer knows your red line so she can fight for it or let the other lawyer know to prepare for trial if they don’t convince your wife on 50:50.

What about income ? Who makes more ? What about health insurance . My ex drafted up a separation agreement and we went back and forth until it was acceptable to both. Once it was signed , I went immediately to divorce . There was no benefit for me to stay separated. I wasn’t going to pay for her health insurance in perpetuity. Was separated and divorced in 5 months . Our son was an adult though .

My attorney didn’t get into the who’s and why’s of the separation and divorce . Only the legalities and the provisions of the agreement
