I would talk to your lawyer. My understanding of one party consent is you have to be one of the parties in the conversation. I’d be really careful about a recording of your ex and a friend.

If it's one-party consent then, yes, it's admissible. Save that somewhere safe like the cloud. When she calls the police on you then play it for the cops. Otherwise, it's part of your criminal defense in court. Her credibility is shattered.

Depends of the state. In some states you must inform the person. Every state is different. If it’s a threat of violence that’s different.

I had my ex-wife physically assault me several times, and because it was becoming a regular thing, every single time I had my phone recording it, and in it you can hear me asking her to please stop punching me and to let go of me and stop hitting me…

Luckily when things got bad, that saved me.

Save those recordings.

A lot of people are saying one party consent other wise it’s not admissible. However, family court does not operate the same way as regular court. Talk to a lawyer!

While this is a lawyer question I’ll just add one thing… if this is just about divorce and domestic violence was never brought up the judge won’t care. If this is about false domestic violence charges it’s definitely a question for a lawyer. Good luck.
