Staying in the house many times creates incentive in the wife to get the divorce proceedings over.

When you leave women usually seek a temporary support order which makes you pay for their living expenses at the same time your living expenses go up thus putting you under financial stress which gives her leverage in the negotiations and incentive to delay. Delay means more legal expenses and frustration.

If you are the breadwinner it is to your advantage to get the divorce over as quickly as possible on fair terms. Remember to many women 50-50 is a loss and to men 50-50 is a win.

So what will you do when she uses technically appropriate methods to remove you from property. ?

says to the police you are trespassing and gets a exclusion occupation order.
Files harassment charges or any of number of methods to remove you.

Just my opinion not a lawyer.

Stay IN the martial home. Go out more often , avoid her , stay in hotel rooms. but DO NOT move out or create a situation of different lifestyle. Maintain the status Quo.

Laws in certain jurisdictions don’t allow for habitation in campers unless zoned recreational/business. A spare room would be more advisable under the circumstances.

I got divorced in AZ. And legally it is better to move out to "keep the peace" than stay in there and risk your STBXW calling 911 and claiming domestic violence. On the flip side, I didn't move out until I had presented her with divorce papers.

I did move out of my separate and sole property house for just that reason. But my exwife didn't drive (due to her great big DUI crash with the kids that caused her to lose her license), so I was able to see my kids after work each day and all weekend long.

In the end, I got my 50/50 custody and I kept my house.

The topic of "abandonment" is grossly misunderstood, even by some attorneys. Here's the reality: if you are in process of a divorce or separation, and you are continuing to honor your financial obligation to pay the bills on the house, no judge is going to agree that you abandoned the house.

eh talk to a lawyer. If there is a compelling financial reason it will probably fly with the Judge.

Judges are human and as long as safety is not an issue you can technically live where you want.

Here's the deal though a lawyer for the wife will want to apply pressure to you and opposing counsel. So... it's very tempting to claim "safety" issues with you being around, which gives them more ammunition to use in negotiation of assets, visitation etc.

Talk to your attorney. If you have a camper I don't see why you can't move camper to be somewhere else. not on the property. If it is a large property you would have more say I guess.

Know your zoning laws and talk to a lawyer.

Zoning laws in my area don’t allow for people to live in rvs for more then a 14 day period.

Nebors parents visit every summer from June-October in their rv.

The Karen of the Nebors didn’t like the fact that they are breaking the zoning laws and caused ton of problems.

We offered them to spend the night in our driveway. Not good enough for Karen. That witch can’t even see our driveway from her windows.

So now the neighbors parents have to move the rv every 14 days to campground paid (for proof) to be compliant to the zoning law.

Karen still not happy.

What are the odds your soon to be X will be a Karen?
