I get the sense there is something he’s not telling you. Tell him to make a burner account and come discuss here. The house has to be sold at a price that is market appraisal rate. No less no more. Thats the only fair number. He can think it’s too high until he turns blue. She’s entitled to fair market rate. She can want the house until she turns blue, but it has to sell. Everything about the sell of the house was in their divorce. He signed that document. If he signed it in mediation, and that’s what it sounds like, then he agreed to it.

Only if her asking price violates the spirit of their agreement can your friend get any legal remedy. If the sale price isn’t mentioned in their divorce to be fair market value, it would be the first divorce I ever seen like that.

If and only if she’s doing something very obstructive to sell the house, then no. If he agreed she can stay until it sold, that’s what he’s going to have to do.

At this point, since she has had ample time to sell, it's time to force a sale and/or have his portion be paid out by her. Wasn't there any terms related to this described in the divorce decree? Have her take out a home equity loan and buy out his half.

If he owns half the house he should be able to be involved with the house selling process. She should not be fully I'm control of selling the house. Need a lawyer to push things. He likely is NOT fully divorced yet as the house is not sold. And the money is not split.

You will need to hire a lawyer to force a partition sale. Maybe a firm letter from one will convince her.

DO NOT default on the mortgage. That is terrible advice.

Stop paying half of the mortgage, let the mortgage go into default.

Eventually the lender will send it to auction and any overage on what’s owed would be payed out. Split that with the ex and move on.

Otherwise he should get his solicitor to file a motion to compel with the courts. Then be prepared to wait a year or so.

I had a court order to have the x sell the house as I was paying all the mortgage, utilities, and her bills while I was in my own apartment.

She was sleeping in the bed that she cheated in. She told her lawyer that I was the hold up to selling the house. The next day we had the order drawn up. The day that she got it she was "not emotionally and physically ready" to sell the house. Talk about changing your narc story on a dime.

The order was lost in the wind in 2020.

My final ruling noted that the court had an order and didnt follow it (rules for thee and not for me). I lost any right to that brothel. She can marinate in it.

My advice, get the appraisals get a realtor to get avg comparable home prices and present to your lawyer/judge what you have. Try to enforce a sale.

Are there any stipulations in the divorce decree? This should have all been handled BEFORE finalizing the divorce.

Get three appraisals, average the three and relist/reduce at that price. If she doesn't want to do that, may have to go to court to force her to comply.

Not a good option but an option, he stops paying the mortgage and play chicken with her forcing her to pony up all the mortgage or reduce the price to force a sale, with the risk of foreclosure weighing overhead.
