Short answer: No, she cannot.

Longer/Infuriating Lawyer Answer: She might be able to get the house if she is able to prove that you have other assets valued the same or more than the house which she cannot reach because of jurisdictional issues. Example: you have a million dollar home in California and you have also purchased and disappeared a million dollars worth of gold bricks. She can ask the judge to let you keep the gold and give her the house. Doesn’t mean she will get it. Just means that she has a basis to ask for it.

You should ask the judge to order the house sold and the proceeds split evenly (assuming it is fully community property).

Ok. Then go have a little hearing and the judge orders the house sold and the proceeds split. If she won’t participate get a receiver appointed to sell it and the cost of the receiver comes out of her half.

Whose money was used for the down payment? Can you show proof that you helped pay the mortgage? Luckily banks keep records of all this stuff so it’s pretty easy to prove what really happened.
