If true it's a far more serious problem. It's called bringing the administration of justice into disrepute(the US has another term but it's the same thing). It would mean that any cases of similar nature would be considered suspect and each person convicted could demand a new trial, in large numbers of cases they simply let the person walk free. Whether or not there's any apology, restitution, or anything else? Varies by case.

Reading through the article, it seems like the biggest issue here are the police.

"She said that interrogators threatened to arrest her if she didn’t admit she had lied and that she didn’t think she would be allowed to leave the police station if she didn’t sign a confession. The woman said she was denied access to a lawyer during the eight-hour questioning". The courts also note that the police do not have a video of the eight-hour interview, which is pretty fucked up. To interview somebody for that long and not be recording it? That is fishy, even if this was a false rape claim.

The defender also had "presented the court with text messages sent between the Israelis that it said showed the alleged rape was planned in advance."

These text, the nature of which does seem ambiguous without proper context, included comments such as “'She’s going to get fucked tonight' by 'them all' and that they would have an 'orgy' with her. One of the suspects also later told police during questioning that the group had discussed having sex with the woman in a 'bad and aggressive' manner, British media reported Wednesday."

What seems clear is that whether the sex with all or some of the males was consensual, the video taping of the sex act was certainly an issue.

Moreover, I think it is important to remember how manipulative police can be. The folks in this forum should be very much aware of that, most notably with the Central Park Five. Police harassed those young boys into making relatively innocent confessions with the promise of being released only to use those confessions to lock them up for years.

And this happens in both directions. A victim of serial rapist Marc Patrick O'Leary was dismissed as a false rape claim after detectives didn't believe the victims story and convinced/pressured her to recant, eventually leading to criminal charges against an actual rape victim.

Based on the evidence put forward in the case above, it seems clear that the certainty of either side of this case is unclear. And frankly, if there was a rape, and the victim had to sit through a video of the event, or know that other people were watching a video of her being gang raped, then that would be horrible for her mental health. Keep in mind, this is not a trial to convict the males involved of sexual assault (in which case I would strongly advocate for the tape being played) but a trial to determine if the rape accusation was false. The video cannot prove it unless everything leading up to and following the event was recorded, so whatever consensual acts appear on the tape, the taping of the event itself was not consensual and there may have been acts before or after the the video starts that were not consensual.

Moreover, we don't know that the video does exonerate those involved; that was not stated in the article. We only know that the prosecution wanted to show it. It may support their case but not exonerate the boys. Nor do we know whether the video depicts the entire event, or only part of it out of context.

I don't know what went on that day, or what the context was, but one thing that is clear is that the police were certainly out of line interrogating somebody without a lawyer and without filming/recording the entire interrogation. I hope that is something we can all agree on.

As the victim of a false rape allegation myself, I know how damaging this can be, so I recognize the importance of addressing these issues. But the same laws that we need put in place to protect young men and boys from police/prosecutor who want to push a conviction at the expense of the truth need to be in place for everybody.

The video can't prove that she has never been a rape victim ever in her entire life, or that all of the boys have always been innocent, but it CAN prove that she lied about specific events she described to the police, which is what the trial is about.

Particularly when there are 12 individual participants involved, getting details right is important.

It could be that she was raped by one guy and falsely accused another or multiple others. Perhaps some of the participants conspired to set up others and she knowingly participated, out of misplaced loyalty to an abusive boyfriend or something.

If she simply mis-identified the culprit that is one thing. But if she provided details which she knew to be false, that would make her guilty of a crime. Even if she is the victim of another.

This seems harsh but it is not like rape is the only crime that works this way. If you mug person A you cannot use as an excuse the fact that you needed the money because person B stole your TV. If you murder someone as part of a gang initiation you cannot use as an excuse the fact that the gang was hazing you.

These considerations are on top of the possibility that she just made the whole thing up.

And yes, there is also some possibility she is telling the truth and Cyprus is just extraordinarily backwards.

It would be nice to get some trial transcripts or something.

Very well put.

However, just because her testimony might not be consistent with what happened in the video, doesn't mean that she is lying. Victims of sexual trauma (if that is what she is) do not always recall of the facts correctly. It's just human nature. A lie is willfully misleading somebody. She may have done that. Or she may have simply not remember exactly what happened. As noted it the case I mentioned above, where a victim of an actual rape didn't remember all the details and changed some things as she was asked the same questions repeatedly, rape victims do not always make great witnesses. The fact that something in the video may be inconsistent with what she said would not be surprising, nor would it necessarily exonerate those accused.

But you are correct. There seems to be so much left out of this. Trial transcripts would be nice.

I'm also curious about the police though. Having somebody who is essentially a tourist get gang raped is not great press for your tourist industry, and they may be more interested in protecting their the Israeli conscripts given that they are trying to build a strong relationship with Israel, rather than listening to somebody on a working holiday I heard was working as an exotic dancer. I don't assume all cops are bad, but their procedure here was certainly more than questionable.

The article has a clear bias in favour of the girl on my reading, so it may not have included things that would be more damming.

So, I've been able to find some sources that give a lot more detail (I can't link but check manosphere and conservative media, it's not hard to find the rest of the story), the media is leaving out a LOT of incriminating evidence against the accuser;

Three (3) of the twelve men accused admitted right away that they had consensual sex with her. These are the same three (3) men whose DNA appeared was present, and the same three (3) men who appear in the video. The video allegedly* shows her enthusiastically consenting to those three and consenting to the filming.

In addition to detaining (and beating) the three (3) initially accused men in an attempt to coerce a rape confession the police performed a rape kit and interviewed thirty (30) people. During the interviews, one of the accuser's friends came forward to inform the police that she was working as a stripper and had previously filed false accusations in an attempt to make money.

Aside from the three (3) men, the other nine (9) men do not appear in the video at all. In fact, it is not clear exactly who the other nine (9) men even were. The accuser claimed she saw up to twelve (12) faces so the police dutifully rounded up twelve Jewish guys staying in the hotel to detain. The police took DNA swabs from all of the suspected men and could find no DNA or other evidence that she ever had sex of any of them. Some had alibis that they were in completely different hotel rooms that checked out.

She confessed to everything and only recanted later on when her parents got involved and started raising money on GoFundMe.

You say it is a video of her having consensual sex, but you have not seen it.

There is so little in this article that no reasonable person can make any assumptions, much less one that the video (which has never been shown) exonerates anybody.

You have a snuck premise in your statement: that the video is conclusive. Neither you nor I know whether it is or isn't. We only know that the prosecution wanted to show it. That means there was likely something in the video that contradicted what the accuser said, but it is not uncommon for the evidence to contradict what the victim of a sexual assault remember (if that is indeed what happened here).

This is well documented, as noted by the case I mentioned above where a girl who WAS sexually assaulted was pressured by police to confess that she'd had fabricated an assault that DID happen because the evidence they had at the time didn't make sense to them and because he testimony changed.

We don't know if the the accuser was drugged before filming began, or if the assault happened after the video runs out.

And as to the police, THEY are the ones who didn't video tape her interview. That is a fact. If they had taped it, they would have brought the tape forward. If they had let her see a lawyer, the lawyer would have said so.

If you accept the set up THESE police used to get her to confess, then you accept the EXACT same set up that the New York police used to get a false conviction on the Central Park Five.

This kind of 'police work' is as likely to get a boy, or man convicted of an assault as it is to get a potential sexual assault victim to confess to a false report.

If you are ok with how police handled this particular case, then you are setting a precedent to excuse and validate the conviction of the Central Park Five.

Strawman. I didn't say they wanted to show a video that proved her innocence. You are treating this in binaries. A video may simply prove that something she said was inconsistent, not that the crime she alleges didn't happen.

It is not necessarily a matter of one or the other. If there was a consensual act or acts involved, and those were recorded, and the assault occurred afterwards, or the video itself was taken against her will, then she has legit reasons for not wanting it to be shown if it is not conclusive one way or the other.

I'm not sure if you legitimately see things in strict binaries, or if you are arguing in bad faith, though I'm happy to give you the benefit of the doubt. That said, when you feel like speaking to the substance of what I wrote and not simply taking one sentence out, I'll be happy to continue the conversation.

If you were actually a victim of a false rape allegation, then you know how critical the credibility of the accuser is.

In this instance, she made claims directly contradicting video evidence.

Her credibility is ruined, she's not a reliable witness to the crime.

So yes, we can say nobody knows for sure, but that's true in every crime. But we do know based on the statements that she has made, that she has lied. That puts her case to bed.
