The article refers to them "hav[ing] sex", so it's the latter unfortunately. I really wish we'd start calling cases with a slightly underage participant in a voluntary sexual act something other than "rape". Sure by law the age of consent deems it rape, but when someone is so close to the age of consent and it was clearly consensual (outside the definition of the law), the word rape is too harsh and kind of misleading. In no way do I support underage sex, but when you hear the word rape that seems more like a violent sex crime and not just slightly underage sex.

I do think it's a little different when you're the guardian of the person, though. It may have been purely spur of the moment and completely consensual, but it could also be the culmination of years of psychological conditioning by the guardian.

That's very true, it's in no way okay and she should be prosecuted by the law, I just think leaving out the word "statutory" by this article and sometimes other articles leads to a not entirely accurate portrayal. We really don't know what happened, it definitely should not have. But when I saw rape in the title I thought of a violent crime, only to be met with the words "had sex" inside the article.

They should refer to it as "unlawful sex" if the underage party was consenting.

Rape in my mind is sex without consent. Now underage means not legally able to consent but they consented in their mind.

However I think this should only apply for above certain ages. So 15 upwards is still illegal but a 15 year old is more capable of consenting than an 8 year old. So even if an 8 year old consents it wouldn't be in their best interest to as they're not mentally or psychically prepared for sex.

It's a tricky issue but I mean that a 16 year old who fully consents isn't a victim really and the person not a rapist but legally that's the term and yeah it seems too harsh a term.

I think their should be revised age of consent laws that factors in ages. So a 18 year old sleeping with a sixteen year old consually though illegally should be more acceptable than a 48 year old sleeping with a 16 year old.

Basically their should be a buffer when ages are close but one is not yet legal.

It might be more that she was this boy's foster mother/legal guardian, similar to teacher/student cases except that there's probably an even greater power imbalance in this scenario

This. If she was a stranger he met walking down the street, I wouldn't want this case brought forward at all. A foster mom? She needed a harsher sentence. She violated a relationship that is more based in trust than most biofamily connections.

Would you ask that question if it was a 16 year old girl? I'm sure you wouldn't have to look very far to find a 16 year old girl who wants some from a decent looking older man, but that's still rape because she's not mentally prepared to not be taken advantage of.

There's a few states where 16 is the age of consent - I live in one of them. Doesn't mean it's morally ok...I think the bigger problem here though is that she was in a parental role, as well as breaking the age of consent in her state. Pretty disgusting.

I see your point, but I feel like the age of 16 is not a good example of this situation as most people have reached an advanced stage of maturity at this age. Many states in the United States have age of consents at the age of 16, and most countries in Eastern Europe have age of consent laws at 16 or lower.

I think though that the latter has more severe sentences depending on if the victim is male or female. In the case of a female victim the perpetrator would get longer jail time than that of the perpetrator toward a male victim as society has a sexist double standard that treats boys and not as victimised in such cases as girls

When we see cases like this, it's important to remember that the law is still the law, and that someone who is sixteen may be able to make their own decisions, but they are also young enough to be manipulated and taken advantage of.

Certain factors ought to be considered such as if he lived in her house and had no where else to go, or if she had been his foster mother for a while and if he had begun to see her as a mother-figure

If you were a 16-year-old boy in her care as a foster child, you wouldn't need a woman to "give it to." You would need a mother figure to care for you because you'd been given such a lousy lot in life that you were removed from your first family. If instead you'd been sexually exploited by the adult who was supposed to care for you, I don't think you'd be posting on Reddit about how funny it all was.
