I would recommend going back by yourself with a video camera and ask if you can get a copy of your child's medical records. When they say, "no," ask why, when they explain, leave and send the video to every major news station in your area.

You have a right to your medical records. No one can hold those from you. Since you are the legal guardian of your child you have a right to their records. You should have told this clerk as such.

IANAL, but I'd say the trainer's response is in general wrong (should be obvious), but depending on the state you are in, could in specific cases be legal.

I think our "right to access" can vary from state to state and can depend on the nature of divorce law and custody orders.

So for instance, if a parent has no legal custody of a child at all, for whatever reason, I can agree it can be horrible not to be informed for the child's medical records, but I can't say a doctor's office is without merit in not giving the records over.

I think it was wrong for the doctor's office to just assume and demand some form of court proof, but I suspect you may have to go back to court to make sure your ex puts your name on all records assuming you have joint legal custody.

My GF was able to not only get my medical records (not our son's - we have no children) but also schedule me for an appointment at her doctor's office. This is an office I had never visited.

I appreciated my GF setting up the appointment - I needed to get a new PCP - but their disregard for my privacy was appalling.

this seems extremely backwards. There should be a court order on file if the father is NOT to see the records. You can't tell a legal guardian they don't have rights to medical records...that's unprofessional and frankly, counter to the medical care of the child.

OP should talk to the office manager and get that policy "clarified".

Ask for that in writing, on their letterhead. If that is their policy they should be happy to provide it to you in writing.

Also, book a meeting with whoever owns the business and raise your concerns.

I work in the medical records department of a mental health hospital. That's definitely in violation of your rights. If you came into the hospital where I work and someone told you that, my risk manager would be on it like white on rice.

They probably thought you were unmarried. Perhaps paperwork that your wife filled out didn't list a spouse?

For fathers, legal custody is only established by the courts or by marriage. If you don't have legal custody, you have no right to medical records. The doctors office could be sued for a HIPAA violation for providing records to a father who doesn't have a legal right to those records. There are a few states who presume legal custody once paternity is established, but it's not a majority.
