My ex wife purchased a cell phone for my 8, now 9 year old daughter. She did not discuss this with me, I did not know this was happening, and I do not agree with my daughter having a smart phone at such a young age.

My question is am I allowed to confiscate my daughter’s phone when she is with me? I keep my phone readily available for them to communicate to their mother and do not deny them the opportunity to speak to each other.

Side note. My ex-wife is out on bond because she was arrested for assaulting my girlfriend and I. There is a protective order and she cannot call my phone. Allowing my daughter to use her cell phone feels like enabling behavior for my ex-wife. If she really wants to talk to her children she will find a way to call them from another phone (mother, neighbor, friend, etc)
