Not together anymore but here’s my story! I had asked my wife at the time for a divorce in June of 2015 and was going to move out after 34 years of marriage. She pleaded with me to stay and try and make it work. During the next year I could see sneaky shit going on, at one point I had received a $50,000 lump sum inheritance from my mother’s estate which was deposited directly into our joint account. She proceeded to open her open account behind my back and withdrew the entire $50,000. Nothing I could do! I was screwed. A couple a months later in July of 2016 she was being a real bitch and picked a fight with my daughter to the point my daughter and her boyfriend left the house. Later that night she initiated an argument with me and at one point lunged off the sofa and attacked me. I was sitting in a recliner so naturally put up my hand to protect myself and accidentally caught her in the side of the head. She immediately said I’m calling the police and did. When they came they split us up and She made up a story that I hit her and knocked her to the floor and then proceeded to choke her. I was charged with domestic violence just from her story, not a mark on her. I was out of the house immediately without any thing aside from my clothes on my back, my wallet and shoes. I went and lived with my sister and immediately filed for divorce. 6 months later we went to court and she couldn’t keep her story straight and I was found not guilty. The female judge told her she had a very Narcissistic/Histrionic personality and was very melodramatic. A year and a half later we were divorced and I haven’t looked back but still run into people that have seen her say she is still spreading that I domestically assaulted her. I did eventually get 1/2 the $50,000 back through divorce proceedings.

In the US police can't charge you. They arrest you and the DA makes charges. If you weren't arrested or served a court summons I'd say you are fine for now. But I'd consult a lawyer and give him/her more details than you wrote here.

Your lawyer will argue that because she didn’t do anything afterwards to indicate that she was in danger - leaving or whatever, that she felt there was no threat. This is absolutely lawyer territory and any money you spend is worth it. Just make sure you talk to a few and hire the best one.

Did you get arrested or a ticket? Or just told you will be charged? This officer may have been lying to try to get you to confess.

Start by deleting your Reddit. Get a lawyer this is called silver bullet method. Should talk to three lawyers minimum and pick the one who can help you.

Unfortunately, the system is fundamentally broken. Making false reports is one of the standard operating procedures in cases of divorce. Google the silver bullet for more information. The worst part of the current system is even after you prove that she made a false allegation, she suffers absolutely no consequences from that. The courts don't care, the system doesn't care, and everything just continues if it never happened.

The goal is for her not actually to win or for you to be convicted. The goal is to whittle you down, and have you quit or simply run out of money.

Ex-MIL tried pulling this on me, and I dealt with it without an attorney.

Being as she had just turned 65 and I was more than 10 years younger than her, an overzealous ADA upgraded it from misdemeanor assault to felony assault (basically, elder abuse).

At my next visitation, they denied the visit, and I was arrested.

By saying two words, "not guilty," it was dropped back to misdemeanor, and I was ROR'd, no bail (I have no criminal record).

The court attempted to force me to accept an ACD (Adjournment in Contemplation of Dismissal); they even cited some caselaw, where a neighboring town justice had accepted an ACD on behalf of a defendant. I informed the court that I would appeal if it did so, as it would interfere with my right to sue (and I had the caselaw ready to quote to the Court).

So the Court didn't know what to do with me, so they made me come in a 3 or 4 more times in the hopes I would take an ACD.

I have a friend who works for the DA's office in a neighboring city. I picked his brain and did some research.

I informed the court that I wanted a trial by jury and would proceed pro se. I was pro se for the last two years of my 6-year divorce, including an 11-day custody trial, so I had some trial experience. I knew they had no case, so I would have made it extremely expensive and challenging for them to prosecute.

Ended up filing a motion for dismissal based on my rights for a speedy trial being violated. The court initially denied my motion (Judge mistakenly thought I had requested an extension, I never had) and I had the appeal all ready to go. Then he turned to the ADAs and asked them if they were ready for trial. They realized they had no case, so they withdrew all charges.

I knew this because at this point they had already shared everything via discovery (as required) and literally had nothing other than her statement. Unlike me, I had actual evidence to present my case.

As the case was dropped, I heard someone mutter from the back of the courtroom, "That's how you win a case."
