Take the kids. Get the deal in writing. That will give you proof she doesn't want the kids and doesn't want to support them. Child support is always modifiable, so you can seek it in a year, after you have firmly established yourself as the sole caregiver.

If you take the kids that gives you such a leg up… as bias as the courts are toward mothers in general the fact that you have the kids and got a new place with them will make every judge in America think this woman is a awful and inept mother.

Not enough information, but it sounds like a good position to be in.

What are your respective incomes? Own or rent? What is the equity in the house? Do you want to keep the house? Do need child support? Can you afford to move out?

If you are able to move out, I would move out with the kids, get yourselves set up (i.e., schools, bills, doctors, in your name). Then 6 months later file for divorce. At least show the court, that you have been their primary for the past 6 months. And hopefully get child support out of it. I would request it. You can at least put it in a bank account strictly for the children.

Do you own the home outright? Who will pay for the house if it’s not paid off yet.

If it were me, I’d take my kids and get the fuck out. I’d stop paying the mortgage and my credit would get obliterated. I’ve survived worse.

Don’t move out of the house if you want it at some point - if you do you will never live there again. This feels like a trap to me. If she later runs to court (likely), the court is very unlikely to award her no custody - and plus you are now out of the house, bc the court will ‘maintain the status quo’ and not switch her for you to live at home. Plus if you move out and take the kids, she fairly should pay you child support.

Someone else already said it but I would do my best to get out of the house with the kids. I wouldn’t sign anything since she wants to pay no child support. Hit her with cold reality after 6 months have gone by and you’re asking for support payments.

She is banging another dude and she will stop at nothing to be with him. Move fast while she is 'blinded by love'. Get the divorce rolling and everything in writing. Move fast. When he dumps her she will go after everything.
