Hopefully you have a rational person but if you did not beforehand move family heirlooms out into safe keeping remember it's just stuff. Peace is truly priceless.

I told my ex to take it all, it meant nothing to me. Getting my life back was all I wanted. Pretty sure I the wind out of her sails when I said that, she knew I didn't give 2 shits. Good luck brother.

If you fear abuse by her, I would have an officer there while you serve her with the papers.

She served me and since has been trying to get me in trouble so I don’t know. I can tell you that I’ve lost 35lbs because of it! No necessarily because of not eating though, I did change two meals to protein shakes as well. But not eating may also be a factor.

She emptied the bank accounts, took me off the credit cards, and changed the door code. Then came the TRO. Denied, but you are presumed guilty, cause there must be something you did. First wife literally grabbed my dog and said I could leave but he was marital property. Police agreed that I could leave but couldn’t take anything.

If you’re still in the house, record. Make sure you’re primary on all accounts. Have your own accounts set up. Have pictures of everything in the house that you care about…I’d go so far as discreetly moving “your” stuff someplace safe. Find your Jedi zen.

I was on the receiving end. No papers, it was a discussion and it sucked. But amicable when the feelings settled.

Be prepared for feelings. You've had time to come to terms with it. She may not have (assuming she is unaware).

She avoided the server multiple time. Then she threatened to kill herself by taking some pills. Had to call the police it was a whole big mess. Does she know the papers are coming?

In most cases service can't be performed by a party to the case unless the spouse being served signs a waiver of service. Not to say you can't present it to her ahead of service. That said, in my case it was after a long separation and her not being on this planet reasonable to the terms. She's the higher earner with a financial advantage and the one with assets to lose. After a final offer and a warning that if I have to file there will be no deals like what I have presented she chose to not respond for 6 weeks until 2 hours after I filed with the court and her attorney received notification. (this was prior to official service from the court). She lost her mind.

All this to say that if it isn't agreeable it won't be well received.
