There are states, Missouri being one of them, where it is “one-party consent”. Which means only one party needs to consent to the recording; the second party does not need to consent or be informed that the conversation is being recorded.

Your state may differ. Check the regulations of your state.

No state is filling up prisons with people who recorded a phone call. The punishment is at best a small fine.

If it helps the police or social agency to take your case seriously, then do it. Your life is worth more than a few hundred bucks.

"Illegally recorded" just means it won't be used in a courtroom.

I’m a big believer in making recordings. I worked for a private equity firm, it was a very good job aside from the fact that many of the partners and officers were sexually harassing me. Once I reported the claims of harassment, they began to retaliate against me. Of course all of these older and very wealthy men provided cover for one another. They thought they could simply lie their way out of it. What they didn’t realize is that I had recorded many of their illegal acts of retaliation.

It was irrefutable evidence. I held all of the cards.

Oregon is screwy. You cannot record someone without their permission unless it’s a phone call in which one person can give permission.

That being said, if you ever need to covertly record someone in Oregon, call someone you trust and have them record what happens in the call.

This is an excellent work around for the legal issue. I know of a women’s outreach and this has been a problem for them. Do you have to disclose the third party is on the line at any point?

Ask a lawyer (licensed in Oregon) before doing this. Most single party consent laws stipulate that the person doing the recording must be a participant in the conversation. Having a third party record it could be a violation.

I think states that don’t allow you to record a conversation you’re a part of protects abusive people. It’s literally a felony to do so in some states. It’s actually disturbing how it can protect monsters. It’s federally legal to do so (one party consent) but other states have more restrictive laws; but for what purpose really?

The purpose of these laws was to prevent identity thieves from wiretapping and stealing peoples' banking info.

Protecting cheaters and abusers was just a side effect. In practice, if you record abuse or someone making threats against you, the courts usually let that slide since you weren't making the recording for nefarious purposes.

I think as a privacy safeguard, it's good. However, it should come with exceptions if the person recording was doing so to record a crime (whether it actually was a crime or they believed it to be). How is that not an obvious exception?

Many states prohibit recording without knowledge and permission of both sides.

I suggest switching to text and emails, and, if possible, cutting off all verbal communication when dealing with abusers. This way you have a written evidence of harrassment and abuse.

I mean, can this still be useful for personal use. Even if you can't really use it as evidence, backtracking usually helps me spot things I would have missed.
