By most state laws, consent only applies one way. This is because most state laws define a rape victim as being penetrated without valid consent and a rapist as penetrating without valid consent. Since in heterosexual sex, it’s the male who penetrates and the female who is penetrated, valid consent only matters one way.

It’s, very biased. In cases of intoxicated sex, the man is by definition the rapist and the woman the victim, even though they both consented under the same condition.

Ask A&M. There was a court case in 2020 regarding A&M finding a guy guilty in a Title IX tribunal.

The guy had nearly twice the BAC of his accuser. His complaint of assault wasn't considered in the hearings because the school never officially filed it.

It's disgusting how goverments and their stupid campaigns will make it look like all men are natural sexual predators. As if sexual desire (drunk or sober) was only a male thing. Pushy women do exist and young guys like me have to deal with them every time we go out (screaming, commenting on your body out loud, randomly hugging or trying to kiss you, slapping your butt, taking pictures, sneaking in the guys' toilets on purpose...) but you can't say a thing because you are a guy and that's normal and they're just having fun, you are just supposed to deal with all the shit they do while drunk, whereas you know what would happen if it was the other way around. In fact you should be proud of getting so much unwanted female attention.

Nowadays no institutions write this rule but they keep it silent and undocumented and still apply this rule. Besides, most Title IX coordinators are white feminist women so don't expect neutrality. She will sign your termination letter.

First, I'll say, the comment section on that post gives me hope.

Second, I have a differing opinion than what I think is the majority. I don't believe alcohol makes you incapable of consenting. Alcohol doesn't change you, as much as it just brings out the real you, lowering your inhibitions and making you more likely to take risks.

Of course, sufficient intoxication can knock you out, and not every person who's drunk (or on something else) is so by their own free will. Those examples must be analyzed separately.

But for examples where people keep consciousness, if they consented to their intoxication, then I think they've implicitly consented to the consequences thereof and the sticky situations it will get them into. It's a matter of basic lack of wisdom and responsibility for me.

The top comments are generally in agreement that it's a ridiculous double standard. That women cannot consent while drunk but men can. That a drunk woman is responsible for her actions if she were driving but not to have sex.

Then you go further down and people just claiming it's a scare tactic. Doesn't exist. Faked. Etc.
