The thing is you also have to ask yourself if the question is reasonable or not in the first place, otherwise you are just passively adopting feminist standards.

Example: A guy has sex with a girl and is getting head. 10 seconds before he is about to come he starts purring 'no.. no.. no...' After he comes he says he was raped. If the situation was reversed (girl getting head) and same thing happened would feminists call it rape? Answer is yes. But that's bullshit. It's understood that sort of thing happens during consensual sex, if it was later found out the person was serious (about not wanting it) it's still reasonable to think the person giving head wasn't raping, it was just bad communication (with the receiver of the head being the bad communicator), and if it wasn't wanted the receiver could have physically twisted away.

So this one should be rejected.

Second example: A drunk man willingly brings a woman to his apartment to have sex. He passes out from being far too drunk. The woman cowboy styles him while he's weaving in and out of conscienceness and he isn't in a state of mind capable of physically twisting or pushing away, and she allows him to ejaculates in her.

If the situation was reversed (man did this to a woman) would feminists say it was rape? Answer: yes. And that is reasonable. If a man had sex and came in a woman who was weaving in and out of conscienceness I'd count that as rape. It works both ways.

Now that I think of it feminist doesn't even have to be in the question. The real question is: if situations were reversed would it still stand true?

Framing the question as if it was reversed, what would a feminist say? is really just exposing the hypocrisy of feminism. Maybe that shouldn't be the main focus, just an everlasting aside.

I'm pretty iffy about some of the stuff there. Personally, I don't think being pressured to have sex is rape. In certain scenarios, at least. Let's say this guy and girl are dating, the guy wants sex, so he asks the girl. She says no. He then starts to beg and beg, "pressuring" her to have sex. She finally says yes, they have sex.

To me, that is not rape. That's a response to some of the comments, not the actual story.

The story is kind of weird too. He says he wants to leave, but can't. He doesn't exactly address why he can't, and he doesn't say that he verbalizes that he wants to leave to the women. As the girls are making out with him, he still has yet to say that he verbally said no or was against it. Hell, even in that part of the story, he doesn't say he was against it to us, the readers. He then takes some cocaine. Here's where it gets in to the very controversial topic. Sex with a drunk person is rape, because they cannot legally consent. Same with cocaine, right?

Here's what I believe. A women and a man are at a bar. The man asks this girl if she wants a drink, she says yes, and he pays for it. The man does not drink, but before the women is even slightly drunk, they start flirting with each other. Obviously in to each other, basically. The women then gets drunk, and wants to have sex with this man. They then have sex. Legally, that is rape. But is it right? Well, sorry, that's not what I'm asking. What I mean to ask, is if it is rape, if the women feels raped afterward, should she be held accountable for her own actions (Getting drunk)? People in the comments seem to be completely excluding that, making him not responsible for any of his own actions.

Now, let's also look at how he describes taking the cocaine. "I take some, because why not" to me, that does not sound like "I wasn't enjoying that, I wanted to get out. I was forced or persuaded to take this cocaine." but rather "I was having a fun time, took some coke because why the fuck not?" which really doesn't play well with the overall message of "rape".

When the fat chick comes in, he doesn't want to fuck her. No question there. He then does so anyway because 1) Coke, and 2) Being pressured. The coke is the only thing I would say makes that rape. But only legally. I personally don't view it as rape.

So, that's my view on that.

Edit: Brain fart, just remembered the most important part. He says cocaine got involved, and he says he was at a bar where he met this women. Know what this means? It means the woman at the bar could have been drunk or drinking, the cocaine at the party could have been used by everyone. He doesn't explain that. So, if one cannot be at fault (Through law) for having sex with someone while drunk, and while using cocaine, which means that the person drunk or using cocaine was raped, why can these women be held responsible for their actions? That's assuming the women did take cocaine, I mean. Laws like that pretty iffy and only apply to certain scenarios, which is dumb. So, again, let's assume everyone took the cocaine, or rather, let's assume the fat women he had sex with took cocaine. That means she also wasn't able to consent. That means that they both raped each other. Kind of like two minors having sex, legally, they're both raping each other. Which is dumb. Seriously, we need a new word for when two people who are not, legally, able to consent.

Just some things to think about, I guess.

Reverse genders, and it is considered rape most everywhere. Each of -intoxication -coercion -deception -absence of affirmative consent has been proposed as a sufficient reason for rape to occur, and this has them all.

I don't disagree with you. I think its a matter of the definition of rape vs. fact of what rape is in practice. This could be described as rape according to those definitions, the women could be said to have been raped too. He denied consent then gave it. It's just not a topic that works in absolutes.

But yes, it probably would be considered rape for a female. That doesn't change whether it was rape or not.

I agree.

Ideally, we'd be able to assume that people can be assertive and will be able to say "no" when they don't want to do things and won't let themselves be peer pressured. Of course, the reality is that many people can't handle peer pressure well and simply aren't assertive (and may not even know how to be assertive).

So an ethical person would certainly take that into account and avoid pressuring people and understand that some people might not want to do something but legitimately not know how to say "no".

All the same, I'm not sure if I would consider it rape in this case. There's the question of if agreeing to something under peer pressure is really coercion (by the legal definition). The biggest problem with considering it to be coercion is that it's almost impossible to consistently determine whether or not it's coercion. You just can't tell what's going on in the other person's mind and cannot recognize an assertive person from a very passive one (well, at least you can't necessarily recognize the difference).

So in other words, he did give consent and this doesn't seem like a strong case to argue that he was coerced. Scummy and unethical behavior on the part of the girls, but I wouldn't consider them having raped him in the eyes of the law (of course, as /u/baskandpurr said, what people consider rape is different from what's legally rape).

I agree. There is a terrifying blurring of the lines and redefining of the concept of "rape." It reminded me of this Slate article:

Carol Tavris is a social psychologist and author of the feminist classic, The Mismeasure of Woman, and, with Elliot Aronson, Mistakes Were Made (but Not by Me). She says she is troubled by the blurring of distinctions between rape (notably by predatory males), unwanted sex (where one party agrees to sex not out of desire but to please or placate the partner), and the kind of consensual sex where both parties are so drunk they can barely remember what happened—and one of them later regrets it. She says, “Calling all of these kinds of sexual encounters ‘rape’ or ‘sexual assault’ doesn’t teach young women how to learn what they want sexually, let alone how to communicate what they want, or don’t want. It doesn’t teach them to take responsibility for their decisions, for their reluctance to speak up. Sexual communication is really hard—you don’t learn how to do it in a few weekends.”

Were those women pieces of shit? Yes. Was there a level of coercion? Yes, via male shaming. Did he have sex with someone he didn't want to? Yes. But the real question is: Did he consent? Yes.

I think we need to be very strict with the use of the word "rape." Rape is the use of force (or the threat of the use of force) to have non-consensual sex with someone, and/or having non-consensual sex with someone when they are incapacitated. And that's it. Blurring the lines further plays into a feminist narrative to redefine a horrible crime into just about any sexual experience someone regrets and will undoubtedly favor women and lead to prosecution of men.

I will say: The group dynamic and the use of drugs and other people brings an interesting question about the line of consent though. What if there were only a few women? Or just two women (one ugly and one attractive)? And the hot woman just made out and the ugly/fat woman wanted sex--which the man consented to to appease the attractive woman? Would people on the thread consider that rape?

There's a lot going on here. People need to learn to say "no" when they don't want sex and live with the consequences, and "yes" when they want it. Likewise, I think it would benefit for people to recognize when they are coercing a person into having sex when they don't want it (again, technically not rape though).

There's just something wrong about it. This isn't a he-said/she-said morning-after encounter. This is several people conspiring to make the sex happen.

You don't need to. I agree, it's wrong, regardless of what-gender-does-what. But does it make it rape? I think that's the crux of the matter. Obviously, if it's rape for one gender, it's rape for the other.

I do think society would determine a group of men doing that to a woman to be a crime, and a group of women doing that to a man not a crime, which is fucking lousy and sexist.

Everyone needs to learn to be an adult and take personal responsibility. The OP consented to drink, consented to go with the women, consented to do cocaine, consented to have sex with a person that he likely wouldn't have otherwise just to appease women. It would be the same for a woman.

Was the bait and switch shitty of these women? Definitely. He obviously wasn't incapacitated, as he wrote a very descriptive post. He needs to take personal responsibility. He gave consent, it wasn't rape. He was being coerced, which is wrong, but he wasn't threatened or forced to do anything.

This is where I start to take issue with your description. The "give her cocaine" "get her drunk." No. He (or she in the gender reversal) chose those things. That's not the women getting him drunk, it's him getting drunk with the women, it's him choosing to do drugs with them. You didn't just shift the genders, you also stripped him of his personal agency in his decision making.

There doesn't need to be use of force, there doesn't need to be threat of force, there just needs to be a lack of consent. Seriously, saying "Stop" and being told "No" (which is an acknowledgement that they fucking heard the "Stop") is fucking rape whether you're being held down, threatened, or neither. You don't need to be threatened to be afraid. You don't have to have force used against you to be afraid.

That's a fair objection, but then you get into endless semantics about what constitutes "consent." (e.g. If the person is unsure, says, "No... I don't know..." and then later gives consent, is it rape? If they give a hard "No!" but then consents because the other person is persistent, is it rape?).

Unfortunately, the difference between what someone considers "rape" and "consensual sex" often times is merely their frame of mind. That's why I'd argue for a stricter definition of rape. Or else you get what Lena Dunham considers being raped (doing cocaine, drinking, bringing a guy home, talking dirty to him to convince herself she wants to have sex, and still considering herself to be raped).

Yes, but your definition excludes the virgin who tells her boyfriend "Stop please, it hurts. Stop please. Honey, stop. Stop, it hurts." and he responds, "No." And she's terrified and it hurts like hell but he won't stop despite the fact she's trying not to cry. It's not like he's threatening her or he's tied her down, but he doesn't have her consent anymore and it seems like she's made that very clear to any rational human being.

Look, there's a difference between actual revocation of consent and reluctantly having sex. Just like there's a difference between a person in an abusive relationship having sex with their partner because they know if they don't they'll get hit or worse and having sex to please your partner even though you don't really want to have sex right then. But that doesn't mean we redefine rape to (1) make it even more excluding of men (You know this would happen. Most stories I've heard from men, there are no explicit threats and it is hard to make a prosecutor or jury believe that any man could be afraid of a woman who doesn't look like a body builder so even implicit threats wouldn't hold well.) and (2) make actual victims feel like people don't take what happened to them seriously.

I would argue he forfeit the right to cry sexual assault when he went home with them. He was seduced by the lure of cocaine and attractive women, and it didn't end quite like he had hoped. If the attractiveness of the person is all he has to go on for it to be rape, then I don't want to be on his side. It's like playing spin the bottle and kissing the ugly girl; being ashamed doesn't remove your consent to play the game.

It's really hard to tell exactly what to call it. I suppose it would be fair to call this some sort of sexual assault that stops just short of actual rape.

The more I read about the variety of criminal acts that can occur... the more I think Canada has the right idea. They don't have a crime called "rape", and instead have different categories and different severities of the crime called "sexual assault".

It makes sense because honestly... if you're forced to do things, if people are grabbing and touching you without consent, if different sex acts that you don't want are happening... does it really matter than much whether a penis happens to go inside a vagina or not? It's fucked up and it's criminal behavior regardless.

Not true. It is fully possible to give consent while under the influence in many jurisdictions. There are varying degrees of intoxication.

Also, coercing someone to have sex is rape in most jurisdictions, although I am not sure this test is met in this case.

You're wrong because merely being under the influence of a drug doesn't remove your ability to consent.

If you have a beer, smoke a joint, or in this case do a line of cocaine, that doesn't automatically mean you are unable to consent to anything. Are you seriously suggesting that people who are not 100% sober are unable to consent? Think about how many people have sex every day under the influence. Are they all being raped? And if you can't be held responsible for consent while under the influence, how can you be held responsible for anything else you do? Should we just let criminals go free if they were drunk when they committed a crime? What if two wasted people have sex - did they both rape each other at the same time? Are we now expected to drug test/breath test everyone before having sex, just to make sure?

I hope you can see why it doesn't work to consider all sex under the influence as rape.

If he was totally unaware of his actions - in some kind of hallucinogenic dream state, blacked out or actually unconscious/asleep, then maybe you would have a point.

Two points undermine that: 1- he felt like he couldn't leave... 2- he attempted to resist the girl and failed.

At that point, it was going to happen with or without him... Any consent seems coerced to me.

The rest is fluff. Drugs played a role, but secondary to those... So whether you're in the "altered mental state = rape" or "does not = rape" camp, it's beside the point.

Nope. There's definitely different levels of discussion, and you, I, and inanimate objects all know there's plenty of non-constructive debate on reddit.

Aside from how constructive the discussion is, I think the context it's being discussed in matters. Different communities are going to have different perspectives on it.

Here, it's going to center on the mens rights side of it, and how this situation and the reaction there AND here compare to how the community reacts to similar situations.

I think both conversations/discussions can have value, and I think it's a good sign that people are willing to hear both sides here. One of my biggest gripes with basically every cause-based sub is a tendency to circlejerk and pick a "right" interpretation and downvote anyone who disagrees. It's nice to not see that happening here, especially over such a polarizing issue.

This wasn't rape, it was a series of bad but consensual choices. If it was a woman who behaved this way, the feminists would be out for blood and claiming that this was rape, but that doesn't mean they would be correct. Regardless of the gender of the victim, what happened is uncomfortable and shitty, but not criminal.

The way I read it, he was coerced into having sex by way of alcohol and drugs. He was definitely in a position where his right of consent was compromised (again, via alcohol and drugs) and I think that it was safe to say that if he was in his right mind, he would not have had sex with that woman.

I didn't know how to feel about this. I let it sit overnight even. I can get the logic in calling it some kind of sexual assault, but he ultimately agreed to most of what happened [from what it sounds like]. And for that reason I think he's to blame for it.

I don't know if I like the idea of coercion/pressure [not sure which is better applied here] being rape. I know it's bad, but you can continue to say no and if it still continues there is no grey area anymore. It's 100% rape and no one can argue otherwise. [well people will try with men, since "boner = consent" to some people but that's another issue]

I don't think we should support people making these types of calls by saying it's rape. People need to be told explicitly that if they end up coerced then they are only harming themselves. May sound harsh, but it's to protect people in the long run. The more grey area, the less of a believable victim you'll be.

If you don't want it, refuse. Period. Plus, I've just never been "for" the concept of peer pressure, for example. I get it, but I think it's still in your hands and that peer pressure is mostly just a way to avoid responsibility for your own choices.
