Important note: Most rape statutes include a statute of limitations. If you wait long enough (several years to a decade), then the legal system will not be able to prosecute and the police will likely refuse to even investigate the complaint. This does not provide license to seek some other form of redress.

Rape is not based on a number.

At best, if you were below the magic number, you will be told you were raped, and you may have big money in your future (and destruction of a relationship). But you were not raped, unless something further below in the chart says so.

Also it seems ridiculous that some people will be banned for life -- for life -- from having mutually enjoyable sex, because they cannot clearly express consent to a court of law. That cannot possibly be ethical. This is why we must move away from the consent system, at least in this case.

Also, many of the things that "do not matter" from a purely logical standpoint, nevertheless DO MATTER when it comes to presenting a case in court, where credibility and evidence are necessary to prove beyond a reasonable doubt that a serious crime was committed.

I disagree with two points:

Did you have sex? (oral/vaginal/anal penetration): Under some jurisdictions rape doesn't necessarily mean penetration. Sexual acts without penetration like for example cunnilingus are also included. And I think they should.

The points at the end "Did you agree to have sex?", "Did you never actually say 'no'?", and "You didn't physically resist the other person?" sound to me like a "Yes means Yes" standard, which I don't agree with. I think if a person in conscious and not threatened, they can be expected to express their disagreement by saying something like "No" or "Stop", or physically resisting.

I disagree with the last statement. If someone is too drunk to know what they are doing, then how can you charge them with rape? That is the exact logic that is used to say someone was raped. If someone sober sleeps with someone who is blitzed out their mind and can't consent then that is rape. But if someone who is too shitfaced to tell a turdhole from a keyhole and they sleep with a sober person, then they can be charged with rape? Isn't that the very definition of a double standard? Isn't it complete bullshit that alcohol only matters when a woman drinks it and not a man!?!?!?!?!?!?!?!? FUCK YOU FEMINISM!!!!!

For starters, if two people both too young to consent have sex, should they be charged with rape?

Second, are we talking about what legally counts as rape or what morally counts as rape? Because there are plenty of cases of statutory rape that do not morally count as rape.

Third, you cannot just stop at statutory rape, because there is a huge difference between an adult raping a 15 year old and an adult committing statutory rape with a 15 year old who wanted to have sex. While both may be illegal, they are different crimes carrying vastly different prison sentences.

Fourth, this would classify sex acts someone does to their sleeping SO as always being rape. If two people agree to wake each other up with oral sex, that isn't rape. (Please note I'm NOT disagreeing with this in all cases, only that there are cases of having sex with a sleeping person not being rape).
