If you read the entire article, the boy coerced her into making the video, then uploaded it to the internet, after which hundreds of other high schoolers then viewed the video. That means he spread her porn to the internet. Which is child pornography.

If the kid had just kept the video to himself, that'd be a different story entirely, but he didn't.

Well, I do think that she did end up with this fucking her life up quite a bit.

The girl's family was harassed, having their home vandalized and receiving numerous prank phone calls, for three years after the release of the clip. The girl claims to have been “subjected to a daily routine of harassment” at school and eventually suffered from “depression, anxiety, mental anguish, embarrassment, and extreme stress.” She was eventually advised, for her own mental and physical well-being, to finish high school elsewhere.

That he threatened her, in a way we shouldn't trivialize, should also not be discounted. This case, seriously, is not black and white.

I also question whether this belongs on /r/MensRights or not, and the sensationalist title doesn't particularly help its case.

14 year-olds know exactly what they're doing, especially when it's wrong. What they don't understand are the far-reaching consequences. They are unable to make decisions based on anything other than the most most immediate needs and desires. Their brains at that stage of development (specifically the pre-frontal cortex), until they are around the age of 25, are physically incapable of making consistent, reasoned judgments. That doesn't absolve them of the crime, but it should be considered in the sentence. As for the question of the girl being an accomplice to her own victimization, well, we could say that about anyone who has been on the receiving end of a deception.

He's not being charged with possession or distribution of child pornography, they're considering federal charges for sexual exploitation of a minor (I'll use SEOAM later for this, since its fucking long), its a significantly different legal principle, and honestly despite being a pretty big men's rights advocate myself, I'm 100% for prosecution of sexual exploitation cases.

Its one thing when you have two minors who are both entirely complicit in generation and dissemination of pornographic material, or when they're swapping material back and forth. But in this case one minor coerced another minor into creating pornographic material, and then distributed it.

Do i think they should throw the book at him? No...

But I do think that his actions should have consequences, the problem with the US legal system and the concept of child pornography is that its very difficult to fairly apply the legal principles involved. Should they find this young man guilty of SEOAM he's likely going to have his life destroyed because it will come with being included in the sex offender registry despite the fact that his actions, despite being wrong, really aren't sexually abusive... he did something wrong, and it included sexually explicit material, but his intentions are questionable because he's a minor...

To quote the article, a point which pretty accurately illustrates how I feel this should be handled :

Sexting is "stupid behavior that young people will regret for years to come, but it shouldn't be treated as child pornography," Florida State Senator Dave Aronberg told the Sun Sentinel at the time. "We're trying to make the punishment fit the crime."

This is bullshit, while there should be repercussions for distributing the video- I don't think it should be involved with the courts/jail/whatever. Both the boy and girl should of been expelled from school and placed in two different schools in my opinion. Or perhaps even disciplinary school. But they're both underaged kids and charging either with "distributing" child porn when they're children theirselves is fucking stupid. They both need some counseling/therapy and behavioral intervention.

I feel like this is a really touchy area where the courts don't quite know how to handle it. The boy is, rightfully, being charged. The girl, even though it was traumatic, should be subject to the "under-18" laws.

I don't have much sympathy for this boy. Should he have the stigma of a sex offender for the rest of his life? I don't know, it is pretty damned harsh as a punishment and should be used only on those whom rehabilitation is impossible. But I do hope the girl's family wins the civil suit.

I think slapping a 14 year old with a sex offender label and charging him with child pornography is extremely inappropriate. Is he a little prick for leaking those images, yes. But who doesn't do dumb shit when they are young? 14 year old's are still forming their morals and personalities, part of this process is making mistakes. I think charging this kid as an adult would do much more harm in the long run than by sending him to counseling and possibly expelling him from school.

Both should probably be charged if we're not going to have any exceptions at all for making/distributing/assisting child porn.

If anything she is the most guilty one because she made it and distributed it. I'm not arguing in favor of charging her but IF we're going to approach this issue with "no exceptions, ever" then why exempt her?

Laws are similar to programing without an else clause, no room for exceptions.

Many people are going to have their lives ruined due to our laws of the land. Its been this way since man could speak. Yet we pretend it doesn't happen. We don't use common sense, we don't set expire date, don't remove old laws, don't modify laws, we just punish people for a moral viewpoint.

But we can always grumble on a forum about it.
