They are deluded into thinking that rapists don't understand consent. They do understand it but they don't give a fuck sadly. Rapists by and large are psychopaths who derive power by subduing their rape victims, and contrary to popular belief, actually derive pleasure from a LACK OF CONSENT.

The legal concept I've never understood is the intoxication factor.

We arent talking about a dude having sex with a girl that is unconscious.

I mean a situation in which you have a male and a female that are both intoxicated. They have sex she later claims it was rape because she was drunk and couldn't give consent. Testimony says she didn't say no she didn't push away he says that they agreed while drunk to have sex. He is charged with rape and goes to prison. What I don't understand is if she is drunk and legally cannot give consent then how can he give consent if he's drunk too and this is an issue of essentially hey he said she said?

We have to get past this concept of Regret = Rape.

If they did teach about consent it would probably be directed at boys to always ask for consent and not the girls.

I'm sure they want to make sure the girls and boys learn the Mary Koss definition of rape and that consent means nothing, it can be revoked mid coitus without having to be vocalized and that anytime a woman starts to dislike any aspect of the encounter, even if she doesn't say no, it is rape.

No evidence required.

Go right to the police or school administrator, you can't trust the boy.

As these are government lessons some boys will apply these to jury decisions they later sit on as adults.

They say "teach the concept of consent" not "teach the concept of consent to boys". It's very important and could very well help with some particular instance of rape ( i'd call them "gray-area".) Teaching young people about how, when and why to give consent as well as how, when and why deny it or remove it ; and finally how and when to detect problematic consent ; would be super beneficial in both reducing rape instances and reducing "regret accusations" - and reducing bad sex instances overall.

Everyone knows what consent is. Feminists want to change that. Unfortunately, they're having success. Currently, rape is sex you don't consent to. Feminists want to change that to rape being sex you don't want, or decide you didn't want with the benefit of hindsight. People consent to sex they don't want every day. I'm convinced Feminists just don't understand Humans; normal people don't keep asking every 5 seconds if they can touch a leg/arm while hooking up. The Consent is generally inferred when you start hooking up; unless the Girl (or Guy) says verbally "No". Obviously if they look really uncomfortable you should stop and ask what's going on; but "aFFirmAtiVe coNsEnt" is fucking weirdo shit.

The problem i feel is nobody can prove consent beyond any doubt.... all ends up as 'he said she said'..

Due to these grey areas, these laws end up having less conviction and acquittal and lots of cases go on for years esp in country like India where population is huge

Yes they seriously do and in part that's because of how broad the definition of rape can be.

Example: in Brazil, rape does not require any physical touch or proximity, only libidinous activity through force or severe threat. A notable case was a guy who order a 10-year old boy to produce nude pictures by threatening to release the previous nude pics. He was convicted of rape and the media nicknamed the crime as "estupro virtual" (virtual rape).

Actually rape does happen because people don't know what consent is. Both men and women feel entitled to someone's body when they are in a relationship. I can assure you, a lot of rape happens in friendships and relationships. People are genuinely not too stupid to understand that yes means yes, but don't understand the concept of no means no, for our individual comfort often comes before anything else.

MM actually yes, with something like 80-90% of rapes being commited by the victim's SO or date, I think that there is a VERY strong link between rape and the understanding of consent.
