Nah, the guy is right. The Fire Island prison, OE 256/5 is absolutely brutal. The inmates are psychologically destroyed quite quickly, as nothing ever happens there. Every day, the inmates are allowed in a 2x2 meter cage for a one hour walk. That is all.

Death penalty should be used to permanently remove someone as a threat to other people. Life in prison leaves the option for escape (however unlikely, it's never fully impossible) and other legal means of reducing or removing their sentence.

I also don't think the prison system should be based on revenge or getting even with the criminals, it should be about removing menaces from society while rehabilitating those who can become a useful, safe member of society with a little work and compassion. On that note, nobody gives a life sentence thinking "Maybe this person can truly repent and understand what they did wrong, or maybe even we'll find evidence later that they're innocent after all." It's always about making them suffer. It feels nice to us, sure, but it helps nobody and hurting someone because it feels good or was convenient is usually how they got to prison in the first place... I just don't like our "justice" system being driven by the same vindictive impulses that drives people to commit violent crimes.

I feel ya, but the example in that alcatraz video above was of a man who disemboweled a woman while raping her when he was 17. He previously raped a 8 year old girl who was his brothers girlfriends daughter. He was found to be of sound mind while he did it with high risk to offend.

Society has to make these calls to protect itself. We cannot allow behaviors like this in general.

Rehabilitation where there's certainly hope for this person to be a solid member of society. But, sometimes there isnt hope, and you have to do whats best for humanity.

And that's when I believe they should be given the death penalty instead of allowing even the slightest chance they could escape and do things like that again, which was the point of my whole first paragraph. Life sentences for people like that who we have no intention of ever releasing are just revenge, making them suffer because they made people suffer. It doesn't help anyone, not them or the families of their victims. So I fail to see how that's better for humanity than just killing them. If that makes me a bad person, then I think I can live with that.

WARREN, Ohio (WKBN) – A Liberty woman already serving a federal sentence for crimes involving the rape of a child was sentenced Thursday in Trumbull County Common Pleas Court.

Candis Wynn, 35, pleaded guilty to rape, gross sexual imposition, pandering sexually oriented matter involving a minor, pandering obscenity involving a minor and illegal use of a minor in nudity-oriented material or performance.

Prosecutors say Wynn exchanged sexually graphic images and three videos of an adult man raping a 3-year-old child.

Wynn was previously sentenced to 25 years in prison on federal charges of receipt and distribution of sexually explicit material involving minors, sexual exploitation of children and possessing child pornography.

She was sentenced to 35 years in prison on the local charges. The sentence will be served concurrently with the federal sentence.

“We didn’t think the federal sentence was enough,” said Trumbull County Assistant Prosecutor Gabe Wildman. “She needed to be held accountable for the rape of her child. There is no time that can right this wrong, but we agreed to the sentence and the family of the child did as well.”

Wildman said the plea and immediate sentencing prevented the family from having to watch the recordings in court and prevented the victim from having to testify.

Co-defendant Daniel Parker is scheduled to appear in court Sept. 29 on charges of rape and pandering sexually oriented material.

Most people won't give a shit because it involes sex and/or a minor. Combining the two everyone shuts their brain off and strokes their justice boner. But I think it's important to be suspicious of the legal system at all times, probably even moreso in popular topics.

Prosecutors do that type of triple dipping all the time. They’ll try to get the biggest sentence they can because in the legal world, as a prosecutor, that’s how you earn pats on the back and that’s how you build your reputation. So they do it wherever they can. It sucks, but at least it doesn’t send innocent people to jail like plea bargaining does.

Triple dipping doesn’t get innocent people convicted really. Plea bargaining is where the prosecution often coerces the defendant by every definition except the one used by the courts to admit and plead guilty to a crime they never committed. Then the triple dipping happens. That stuff occurs at sentencing, after a guilty verdict has been reached or a guilty plea has been entered.

It helps them get plea bargains too. You commit one crime but the prosecutor throws in 5 more, demands the max time for each, and tries to get them served consecutively. That's why you hear stores of defendants facing "up to xx years". Now that the deck is stacked against you they "negotiate" plea bargains. This also keeps the system running smoothly because if everyone rejected plea bargains, exercised their right to trial, and defended themselves then the system would be overloaded.

Actually have many friends and peers who are still in that area of the law.

I appreciate that you and so many of your friends sit around and talk about how they or someone they know was innocent but took a plea because 'the system' but in reality people just don't want to admit that they were guilty, that they're a criminal, they got caught and they took the plea because it was a gift and they should have gotten a much more severe penalty.

There's no great solution. Either you get rid of plea agreements and back up the courts even more, or some innocent people plea out. It's a problem that Blackstone's formulation really doesn't address, especially because we have no hard numbers on the rate of wrongful pleas.

This is extremely true. The prosecutors will follow through on all their threats to increase their reputations as formidable lawyers, and yes, since 96% of cases are handled via plea bargaining, the system would be completely overloaded if everyone went to trial.

In fact, prosecutors can punish people for exercising their right to trial.

It's Ohio. There was another Ohio case on here recently with a rape. The issue is that many states have broader terms so they can apply more broadly. Ohio has a specific rape charge that includes sexual misconduct with a minor, while other states use other terminology, such as "sexual assault".

Newspapers don't want to be sued, so they report the facts. That means that they report the actual charge, not their interpretation.
