I used to work in a high school and had to have a discussion with a few boys about “sac-tapping” and how it was a form of sexual assault. It is viewed and taught that way but you are contending with “boys being boys” as an attitude with this.

It's extremely gross and vile. It's portrayed as humorous and/or empowering or cool for women to do it as well. Then there's the fact that it's basically part of the formula now. Every movie needs to have it at least once and it doesn't matter what it is. They will shoehorn it in. Saw cruella with gf the other day. In the US, the 14th amendment grants every citizen equal protection of the law.

However, sexual assault/ rape laws, as currently defined, provide people with female genitalia protections that citizens with male genitalia don't receive.

Specifically, they provide direct protections from genital harm and de facto protection from unwanted pregnancy and parenthood.

In some (but not all) places, attempts have been made to make these historically male punitive laws gender neutral by using gender neutral language and providing a means by which a male could, in specific instances, be considered a victim. Specifically, a male may be a sexual assault victim if he is anally or orally penetrated or if he is forced to penetrate someone else anally, vaginally, or orally.

While this definition does permit many men to be seen as victims, it does not extend any equal protection to men. The law considers a penis only as a potential weapon, not a vulnerable target to be protected like a vagina, mouth or anus. The testicles do not appear in the definition at all. Therefore, these laws provide no protection from genital harm to people who do not have female genitalia.

Furthermore, while prohibiting penetration of a woman's vagina without her consent makes it essentially impossible to impregnate her without consent, the same de facto protection from unwanted pregnancy is not provided for males simply by prohibiting forced penetrations. Semen may be obtained from non-penetrative sex and used to create a pregnancy without consent of the father, or a man may consent to mere penetration of a vagina but be exposed to a heightened risk of unwanted pregnancy through birth control deception or other means.

Citizens who were born with male genitals have committed no crime by mere circumstance of their birth. They should enjoy the same protections as all other citizens.

It would not be difficult to write sexual assault laws that provide equal protections to all citizens, rather than discriminating on the basis of gender/ genital type. For example:

"A person commits sexual assault when they touch someone else's genitalia, using any body part or object, without the consent of the person whose genitalia was touched."

Because sexual assault laws provide two separate protections, perhaps the term "rape" could be retained as a second crime distinct from sexual assault with a second definition along the lines of:

"A person commits rape when they take any action which may lead to a pregnancy without consent of the other potential parent"

It is a function of biology that it is more likely that a single action might qualify as *both* sexual assault and rape under these definitions if the perpetrator is male and the victim female. However, that should not mean that males (as well as trans individuals with male genitalia) should not receive both equivalent protections.

Yes, I agree with you. And it should be the exact same thing with spanking. More people need to wake up and accept the fact that spanking a child is sexual assault. You're putting a part of your body on a child's ass (yes the ass is a sensitive, erogenous, sexual part of the body) and you're doing this to a minor and someone who cannot possibly consent to this (and I very much doubt that anyone in their right mind, even an adult, would consent to hit there by their PARENTS or a RELATIVE), and you're doing this to the child for the purpose of inflicting pain and humiliation. If anyone did this to an adult on the street, no one would hesitate to call it a sexual assault and say that this person should be in jail for sexual harassment and sexual assault.

Think about that next time an idiot say that if you don't hit (sugar-coated as "displine") your kids, they'll grow up to be delinquants and criminals. In fact, it's the other way around. Being slapped and hit while growing up, being subjected to violence in the home, not growing up with parents who practice peaceful/non-violent parenting, increase the risk that the child will grow up to be a delinquant or criminal.

Anyone who spanks their kid does so because they lack self-control. It is much easier to simply hit them than it is to actually try to teach them and reason with them. Hitting them to teach them a lesson, definitely teaches them a lesson, but it might not be the one you're trying to teach. And spanking doesn't earn you any respect, it just teaches them to fear you. If I had kids (I have two little nephews but no son or daughter) I'd rather be loved and respected by my kids than feared by them.

It is aggravated assault, not sexual assault. Targetting the gonads is an aggravating factor but punching them for the purpose of causing pain and injury is not a sexual act.

It is not sexual assault unless the perpetrator is doing it for sexual reasons. In the same way, punching a woman in the chest is just assault in and of itself but grabbing the chest is sexual assault. As defined by the DOJ, "The term “sexual assault” means any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent." I would not consider it a sexual act to punch someone in the genitals in and of itself. It is clearly aggravating and demonstrates a malicious desire to do harm, but it is not for rhe perpetrators sexual gratification.

Sexual assault needs to (or should need to) provide the perpetrator with some type of sexual gratification. In most cases, the person doing the groin hitting isn't getting any kind of sexual gratification from it.

Rather than trying to adopt the feminist approach of "OMG he touched me! RAPE!", we should be working to actually define sexual assault as assault with a sexual motive.

Rub up on a girl's ass in a crowded club and whisper "that feels nice" in her ear? Sexual assault. Smack a girls ass after winning a point in a coed volleyball game and tell her "good job"? Not sexual assault (and arguably not even assault).

Sexual assault, in the form of touching another person's sexual organs without their consent, is humiliating and demeaning, but does not usually involve physical pain or lifelong consequences. Hitting a man's groin, on the other hand, is not only very degrading, but also horribly painful - one of the worst pains that can be experienced by a human being - and dangerous, with life-threatening risks of testicular cancer. It is a horribly barbaric and sadistic act when done in other situations than self-defense where one's life is threatened.

Firstly, don’t disagree with the sentiment. Have always been disturb that the media etc uses male pain and physical violence against men for comic relief. But the sexual in sexual assault doesn’t just mean “involving sex organs”, most definitions of sexual assault include the language that the act is sexual in nature. Not all, there are always exceptions of course, but a lot of cases of people being kicked in the balls are not for sexual gratification and it is not considered a sex act so it doesn’t really make any sense to consider it a sexual assault.

Not downplaying how wrong it is, just really don’t think calling it sexual assault makes sense and honestly it downplays what sexual assault is. Like men who have been kicked in the balls have not experienced at all the same thing as men who have been sexually assaulted in the actual meaning of having had sex acts forced on them.

It depends. We have to remember that sexual assault is defined by intent.

So, if you kick a guy in the balls for the purpose of causing pain, then that's assault, but not sexual assault. But, if you kick a guy in the balls because you derive sexual pleasure from it, then that is sexual assault.
