Agree with everyone else, don't leave the house.

From this point forward you DO NOT listen to or follow anything she tells you. She is not on your side, she is not operating with your best interest, or even fairness, in mind. She is no longer the person that you loved and trusted.

Speak to a lawyer now, file for divorce as quickly as possible. Absolutely no more sex with her.

Start recording all conversations on a recording app on your phone. If she speaks to a lawyer there's a good chance that lawyer will recommend she files a false domestic violence charge against you, so you MUST protect yourself.

Start educating yourself on the divorce process and family court system in NY.

She’s abusing you. Stay in the house. Get a pocket pen recorder device ASAP and record. NY is a one party consent state you don’t need to tell her. Start finding a lawyer ASAP. The property is “equitable distribution “ meaning basically 50/50 (with exceptions for inheritance kept in the same name). The tricky part will be custody and spousal support. Document and note the time you spend with the kids and what you do (school drop off/pickup, school trips, doctor and dentist visits etc).

We would need more details, but I think others agree it doesn’t make sense to just foresake what is lawfully and justly yours.

Everything purchased from the day of the marriage and onward is half yours- regardless of whose name it is in, or who spent the money on it. Make sure you get that half. Anything earned since the day of the marriage is half yours. Any debts y’all took on during the marriage is half yours also.

Again, doesn’t matter whose name is on the cars. Be aware, if she purchased two cars before you married. And then when you married you bought the third car. Then she might be able to make a strong case that she owns the two, and she owns half of that third car. Leaving you with half a car.

I have to assume you’re renting, and don’t own a home. But if this is the case, you’re still on the hook for half the rent.

Long story short- you’re going to want a lawyer. Half of everything since marriage is rightfully yours and would advise to get that. Do not give her ammunition by arguing with her or fighting. Record all conversations. It’s wise to make a list of what is yours and what is hers and what is half-half.

If you think divorce is inevitable get a lawyer and get temporary orders in place. Avoid leaving the house. But chances of DV accusations goes up. Also it looks bad to a judge if you have kids. Temporary orders will help you if you have to leave. In my case - I avoided leaving - so she left for her bf’s house! I got the house - after buying her out.

DO NOT LEAVE!!! File for divorce, once you take inventory of all things, then and ONLY then, if your attorney advices to leave, then ok. What you want to do is avoid ANY chance of her trying to start something physical and file false domestic violence charges.

You can try counseling, but probably is better to end that relationship since you don't have kids (easy) talk to a lawyer to write down the requirements. Go with her to set up that, so she can see and agree about a true share of the goods and... If she makes more money than you , you could be getting some alimony.

Rule #1: only listen to your lawyer in divorce

It is in her interest to deceive you, lie and trick you early on in the process.

Believe it or not, she will be your enemy soon. DO NOT LISTEN TO HER & do not leave the marital home until your lawyer approves. Trust us, we have learned the hard way.
