Those laws really should be extended to cover the accused too. With a crime like rape where the court of public opinion has a tendency to sentence an accused man to a life sentence of social ostracization regardless of the outcome of the trial, it would make sense to wait until the court of law has made a decision.

Well, the original idea is that the government shouldn't be able to charge and/or convict people without telling us who they are and why they're doing it.

If they could, then it creates a situation where the government can take you from your home in the middle of the night, hold you in jail, convict you, and then keep you in jail for the next 20 years and no one would ever have to know what happened or why they did it. Which is basically Soviet Russia.

I definitely agree that were I in that situation I would want my information withheld, but there's a balance that needs to be struck somewhere between privacy and transparency.

I hate this. The guys name is dropped immediately every single time a rape case is even thought about, but the women are always protected. This guy lost his job and will be labelled as a rapist for years, despite being falsely accused, and all she gets is a slap on the pee pee.

And why do behavioral stereotypes exist? Because we all know and have seen the behavior. To be a decent human being you don't use stereotypes to rush to conclusions about anyone, but to pretend that because a stereotype exists therefore all accusations of stereotypical behavior must be false? That's being willfully dishonest.

Angry resentful people exact revenge in myriad ways everyday. False accusations of sexual assault happen to be women's easiest way to really hurt a man, due to the lack of evidence required to lay such charges. This is why despite feminist lies to the contrary there are so many more false accusations of rape than of any other crime. It's not because women are inherently more evil than men, it's because it's such an incredibly powerful weapon and so simple to use. All that's required is some witness-free alone time with your victim and his life is over. Even in the extremely rare cases like this one where some justice was served, if he gets the $5K damages it could never compensate him for what he was put through by this stereotypically revenge-seeking woman.

Traditionally the defense at trial in a rape case is to attack the "victim" by showing that the victim was promiscuous, that the victim consented, didn't fight back etc., ie that it wasn't really a rape. If false rape accusations are prosecuted, then people who might make a false rape accusation should be more hesitant to make those accusations. More resources could then be devoted to valid cases and society would take the cases more seriously knowing that it is less likely that someone would bring a false accusation.

As with any crime - it should be reported immediately, evidence of any kind should be documented and preserved. I realize that sentence implies a lot of further humiliation to the victim, but it's the reality of the situation. Reporting it weeks, months, (in many cases) even years later means the only evidence will be the victim testimony - thus the only defense that can be posed is character assassination.

People are prosecuted for bringing other false claims, so I'm not sure how much it would deter actual victims,but if liars are deterred, then real victims would be more easily believed.

The reason that promiscuity is used as part of the defense now is to claim that someone who has lots of sex was probably more willing to have sex and since the whole case is he said she said, it dirties up the reputation of the victim. If there was more likelihood of prosecution of false accusers, judges might be more willing to keep out reputation evidence.

I don't think it will make much difference when it's one person's word against another, the defense will always try to discredit the accuser. That being said, false accusations, especially of something as serious as rape, must be punished. If not to deter then because a crime was committed, but rapes also need to be reported. It will take someone a lot smarter than me to figure out how to best handle them.

No not at all, and I wholeheartedly agree that those who maliciously use the justice system to ruin somebody should be punished.

I'm saying that it's a difficult thing to execute in practice though. In a rape case, the defense is usually centered around the accuser's credibility. Essentially accusing them in turn of lying. If the defense is able to convince a judge or jury that the accuser is lying, and it is then accompanied with a punishment, it could lead to a reduction in reported incidents because victims are now worried of not only having to relive the incident and having their morals and lifestyle called into question, but now could also face punishment.

Just playing devil's advocate. I have no idea how to crack that nut, but it's a very real issue.

Because if an actual rape victim knows the punishment for false rape allegation is extremely harsh, they might not speak out out of fear of not being able to convict the perpetrator, and being labelled a false ra pe claim. The justice system is a joke.

Not being able to get a conviction doesn't result in a false accusation. The accused will have to file a civil/criminal case on charge of false accusation/libel/defamation and for damages against the accuser. If there is evidence that it was falsified (deliberate lie/ manipulation of evidence/etc), only then it is a case of false accusation. Being in this gynocentric society, even if it is proved to be false accusation, the woman will probably escape punishment, due to feminist lobbying and pussypassTM. This is one way in which feminism directly harms men or obstructs men's access to justice.

You do realize that "enough evidence to convict of rape" and "enough evidence to convict of false allegation" are on entirely opposite ends of a spectrum separated by an enormous gulf of "not enough evidence to prove anything either way," right? Moreover, conviction of false allegation requires an entirely separate legal motion, and the vast majority of the time, the DA will refuse to even initiate it even when there is overwhelming evidence of false accusation.

Or do you mean that failing to secure a conviction might mean that questions are cast about whether the woman made it up? You know, kind of like how even a false allegation will follow a man around for the rest of his life. Her name should be put on a False sexual assault registry. That registry is public, online and permanent. If she ever accuses anyone again, her registry definition should be made public to the judge, prosecutor, and defense before charges are filed. If it goes to trial the first thing the jury hears is the full text of the registry definition for the nasty cunt.

She's made to pay expenses for the trial that amounts to almost $19k and $5k in damages to him. I don't know if there's taxes on it. But, I think small claims court has a cap on maximum $25k. And on top of this the court hides her identity.

I would still prefer jail time for false accusers. Well off women, might still get enough "victim cred." from falsely accusing someone, to justify paying what to them is: virtually a pittance.

$5,000 in damages is a pittance. If his name got slandered in the media as a rapist, and the amount of time he would have lost having to deal with this false accusation,then at least 100 times that should be sufficient compensation

Good to see this being taken seriously. And the narrative that taking false false accusations seriously is harmful because it makes victims afraid to come forward is completely illogical- punishments would only be given when a claim is proven to be false beyond a reasonable doubt.

Why isn't the man's identity protected. I was going to say "at least until he is found guilty" but she was found guilty and they never disclosed her identity. Guilty rapists should remain anonymous.

I do not like that the one bolded line in the article is quoting her defendant saying it "plays into well-worn sterotypes". Even when she's found guilty, the article is pushing the agenda that this could be a slippery slope.
