Ya, until he lowers his guard as she plays innocent then pulls the pocket pistol out and finishes him off, or the other guy comes back shooting. As a person defending yourself, you don't know what they have and you SHOULD absolutely assume the worst. The reality is that they attacked him and he fought back. There are consequences to that. I am sure most people if they got bested in the moment would say "Don't shoot me!" Then, you show a weakness and BAM you are dead. This was a frail 80 yr old man, probably terrified, broken his collar bone from them, and when he finally one-ups them by pulling out his gun we should just accept that. She got injured in the first shot. Injured people still shoot back. There is a reason police aren't trained to shoot people in the arms and legs because in real life they don't drop the weapon. The injury just gets the adrenaline pumping even more and they keep shooting back.

The New York law says you can kill a burglar as long as they're in your building, or attempting to commit arson. If they leave the building, you can't kill them.

It even says in the very next section:

A person may use physical force, other than deadly physical force, upon another person when and to the extent that he or she reasonably believes such to be necessary to prevent or terminate what he or she reasonably believes to be the commission or attempted commission by such other person of larceny or of criminal mischief with respect to property other than premises.

I'd like to point out that your initial claim, "Actually in most states, you can... use lethal force to reclaim your property immediately after a robbery" is most definitely bullshit.

"Most states" means more than half (at LEAST more than half). I guarantee that only a handful of states have similar "execute people to get your shit back" laws.

The Byron David Smith killings occurred on November 22 (Thanksgiving Day), 2012, when Haile Kifer, 18, and her cousin, Nicholas Brady, 17, broke into the home of Byron David Smith, 65, in Little Falls, Minnesota, in the United States. There's no Stand Your Ground law in California, but most States recognize Castle Doctrine, including California.

Also according to California Criminal Jury Instructions, a jury can acquit someone under section 505 and 506 which state:

A defendant is not required to retreat. He or she is entitled to stand his or her ground and defend himself or herself and, if reasonably necessary, to pursue an assailant until the danger of (death/great bodily injury/<insert forcible and atrocious crime>) has passed. This is so even if safety could have been achieved by retreating.

So pursuing her could count as self defense since they attacked him in his home. So up to a jury on that one.

Also, if he or his attorney can show he believed he was in danger, it would be self-defense, even of he wasn't correct about the danger. At least, that's apparently what California law states.

Also, no duty to retreat in California.

Somewhat up in the air I suppose.

To me, it sounds a bit like he executed her. The guy ran off, she was on the ground from a wound and pleading for her life. Having said that though, the news could easily be leaving out details or exaggerating others like they've done with most high profile shootings.

Without hearing the actual evidence, I couldn't say either way.
