You need to file a motion to enforce placement. Have every instance documented and if poli e were involved, get those police reports and file those along with the motion. Also file all documents that show she is behind in childcare.

I’ve been in constant litigation with ex over last 5 years. 50/50 custody. Some of the issues are similar to yours, including order violations, false police reports and petitions for OoP, etc. Essentially, she’s significantly moneyed and runs to her attorney and court constantly instead of addressing issues directly. My honest advice is use attorneys as long as you can afford them. Don’t use shitty attorneys. A lot of what you’re dealing with will depend on the judges and their relationships with attorneys being used. How judges rule varies, some judges will rule for 50/50 custody unless you’re an axe murderer. Some judges love awarding fees to the petitioners, other judges are more conservative. Petitioning for sole custody would have to be supported by a significant change in circumstances and your ability to prove it. AFC will also conduct an eval and provide their reco to the judge. Dealing with psycho, litigious exes is a nightmare, you have sympathies.

Which county, state are you located? Big difference in enforcement across the US. In many large cities, enforcement is non existent and contempt is ignored. The general rule is that courts want you to work out issues between yourselves

Been through this. I filed a contempt charge with the court. She could have been given a few days in jail but I agreed to a slap on the wrist because it seemed like sending mom to jail would’ve been a bad look for me. Fortunately it worked.

Do you think she’s doing this because she’s: spiteful? Hateful? Oblivious?

Not sure where you’re located but refusing to give a kid during custody time has ramifications. what did your lawyer say? You said what their thoughts on asking for more custody is but what about her violating court ordered custody?
