Divorce is when you really start breaking the legal bonds. Separation is when you don't live together and you still pay har bills mean while other dude is already banging her.

You would really have to provide the state that you live in.

The legal requirements that define separation vary so widely between states, that a good answer in one state would not be considered a good answer in another.

Legal separation means you spend money twice once you file for divorce. It's a waste of money just do the divorce. Unless your state requires it.

In the state of Oregon, at least, there’s no real point/advantage in a legal separation unless you had some sort of religious opposition against divorce or something.

When I was looking into it, the only benefit would be that it would be easier to legally become married again to the woman I would be legally separated from. I went the divorce route.

Depends on the state but legal separation can give you all the assets you earned. This is because of 1) There is typically no waiting period for legal separation and the form is very simple with a check box saying 'each spouse agrees to keep assets they currently control'. If you can get your wife to sign one of these, its a simple e-file 2) Some counties have option to use court facilitators to file final legal separation and get it stamped by Judge, therefore court visit's are not required

It's much more complicated in case of a divorce where you need to go through lawyers and provide full financial disclosure

Check to see if you’re still responsible for incurred debts…. Most states you remain responsible for the other still. That by itself would be a deal breaker to me.

Need more information. What state? Are there any children? Why consider separation vs. divorce? Who is interested in termination vs. working in marriage? Assets? Length of marriage? Etc...

In general, legal separation is not a good idea. Assets and debts continue to grow, potential spousal support continues to grow, and unfavorable status quos can be created.

If the marriage is dead, it's dead; and it's best to proceed to divorce. Ultimately, you want to have as few entanglements going forward (ideally zero), and separation just delays this process.

Some states require separation prior to divorce. But that's a legal status, not a physical one. People can be separated and still live in the same home.
