The minuscule difference in your earning should equate to basically zero child support.

Don't do it. Listen to me as someone who went through 10+ years of this. Her attitude and mind will change 2-3x a year. Either way, you need to keep your child custodial if you give her custody now and let her walk. She'll still come back for money. And, good luck getting custody back once she has moved.

Get a lawyer and fight for your child's life now. This is your best chance. Once your wife moves with the child your battle is 10x harder.

In most cases child support must fall within guidelines and you cannot negotiate it away from the other parent aside from adjusting the co-parenting time in some jurisdictions. If you fall below guidelines, expect the judge to reject it. Plus, it's always modifiable so she can go back for more later.

In short, DO NOT make an agreement based upon their promise of reduced child support because it can be changed.

Anything you agree on, put it in writing. If you can have her terminate the right to get any spousal or child support that'd be great.

If she can't afford to live there then that's her problem. The kids stay though. She can get herself a small apartment and have the kids over daytime only for now, until she can afford better. There are always other options besides take the kids and run away from dad, she just doesn't want to be the one to adjust. Which is too bad because she's the one with a problem.

Find a solution that works for you, one that doesn't involve paying less child support on her word that she won't ask for more later because you can't depend on that.

She can 100% come back later for child support. Child support, technically, is a right of the child(ren), so she can come back and ask for it up until their of legal adult age.

Don't do it! It's a scam!

What is going to happen is that you'll sign away your custody, in exchange for reduced child support. And then guess what? The judge will sign off on the reduced custody and then blammo, will put in the regular Child support calculator, and with it the reduced parenting time. And you'll end up paying more in Child support than before.

And you'll get screwed over in the end.

Fight for your custody! My exwife tried that trick and she was dumbfounded that I didn't fall for it.

If it's not on the record with the judge's approval as the official parenting plan, it does not exist. If you don't pay correct child support based on some agreement the judge hasn't signed off on, you will absolutely get hammered for it.
