That is insane. I’d want to know just to lay it to rest. Up to you but there are sites like Papa DNA where you can get a test. Just need hair samples so don’t need mama approval.

You have to get a private test done ASAP. Its not your state law, its clearly mentioned on the form when you file or respond. You hopefully contested during the response

I believe it’s something like you accepted this child as your own during the marriage and that has ( I think) legal implications.

You can have a paternity test done thru your kids doctor...and regardless of what your lawyer or court says plz do so before you're ordered to pay child support on a child that potentially isn't yours. It's extremely difficult to get that child support removed once you gotta start paying it

All that the courts want is that the kids are taken care of financially til they're 18 years of age. They don't care if the kid is actually related to both parents or not until it's proven otherwise

In my case my now 5 year old i figured out is not biologically mine. I was told that it is after 4 years you could be held to he is yours in Nebraska. I wanted to continue to raid him anyway so that is working on my favor. She had another child that I just got a test for in the beginning to start contesting it and won’t have to pay child support for him.

Lawyers are like doctors you can get a second opinion. If you are not comfortable with what the lawyer told you concerning the paternity law in your state. There’s nothing stopping you from seeing a different Lawyer and getting their opinion concerning what the law means.

Everyone needs to add these two words to their vocabulary: "presumed paternity"

ANY kids had by your wife are assumed to be yours. Even for a few months post divorce. usually they give the man some time (weeks months not often years) to contest paternity. However after that time elapses (assuming they gave you any time where you live) it doesn't matter who the bio dad is. YOU are responsible. In most places after that time DNA wouldn't matter.

You're thinking, this is a system that rewards parental fraud? Yes. It does. It is designed to give the man insufficient time to catch the fraud so he can be trapped for decades in paying for the affair child. He can never escape and the mom can keep him on the hook for decades.

Chatgpt can tell you how much time you have where you live. In Ontario you have "before or shortly after the child is born". So a lenient court might give you six months. Another court might give you 3. Can you imagine in the first three months you have to deduce and prove your new baby isn't yours?? It's a crazy standard.

But it's designed to be.

You can do it yourself, as others have said. You can do a cheek swab or grab some hairs. I went this route.

I understand your situation. I have two kids, 10 and 8. I'm certain that my kids have the same father, since they look so similar, I'm just not certain that I'm the father. I was with my ex for 20 years and discovered that she had multiple affairs during that time. I did my own mail in paternity tests. I've had the results sitting in a drawer for over a year and I've never opened them, because I'm not sure I can deal with the results.

Can you do a paternity test yourself? At the very least, you'll know; don't have to act on it or prove it.

I know in France it's illegal and up to a year in jail, and in Germany it's a fine of 5k, maybe your country is more lenient.

What kind of evidence do you need to make a court request it?

Why would you have to ask for a paternity test? At his next haircut, just pick up a few strands and send it in.
