There could be a bit of a misconception about prenuptial agreements here. While it is possible to enforce one that gives very little to the non-earning spouse, and strongly favors the breadwinner, courts tend to go out of their way to help the litigant who would like it defeated. I'm not saying that they don't work, but a prenuptial agreement like the one I describe is not something to have complete confidence in. Prenuptial agreements exist, by and large, to approximate the division of assets that a court would make at given durations of marriage. Most of them are a way for the paying spouse to (hopefully) limit downside and avoid spending $2-3 million in legal and accounting fees. Similar to the liquidated damages concept. Amber Heard is a working actress and probably makes some kind of living (though I don't think I've ever seen a film that she's in), and if she does marry this guy and have his kids, she could easily make the case that she ended her acting career to have and raise Elon Musk's kids (assuming she does end it or go in some kind of 10 year hiatus). I don't think that she's the kid of actress that producers will have an interest in after 10 years off screen.
Think about that for a minute. Do you think that this woman would have kids for anyone but a very, very wealthy guy? Halt her career for it? Maybe the boy next door who really loves her and will always treat her well, right? Never. She doesn't even remember who the boy next door is anymore. As one very well-to-do female friend said of meeting her ex husband (and father of her children): "I wouldn't have given him a second look if he didn't have very, very significant prospects and that initial $1 million in the bank." She married the guy, bore his kids, and now has half his rather large fortune (that he made, and did not inherit).
Hypergamy as a law of nature is as real as the need for nourishment and shelter.
We all like Elon, but maybe IQ doesn't correspond at all to what most of us would call street smarts. Could she possibly be worth risking some large part of what he's built?
