Not false allegations, but malicious false allegations. In other words, she made it up, to use community resources, as a way to harm or control an individual. That is how we need to be talking about it. For one, it lets the nay sayers know (and third parties listening in, like in a debate or something) that you don't mean cases of mistaken identity.

As far as "but less raped women will report!" Why? Because they might get accused of false rape and may go to jail? No, no, no. Malicious False Allegations are intentional, and that means the prosecutor has the burden of proof on that she made it up, deliberately, for the purposes of harming or controlling someone.

I would be worried about introducing punishments simply because most false-allegations are revealed as false by the admission of the woman.

We don't want to create a scenario where a woman, after making a false allegation, can't back down for fear of going to jail.

The best solution is what it always has been "innocent until proven guilty", this goes for both the potential perpurtrator a d victim. If courts haven't they evidence to prove things either way, then they must walk away from the situation.

I think this needs to be a crime beyond filing a false police report or perjury when it’s aimed at arresting and punishing an innocent person. (Because attempting to have an innocent person serve prison time goes beyond simply lying)

I agree an appropriate penalty should be in line with what the innocently accused would have suffered.

I also think that falsely accusing someone of a sex crime should itself be considered a sex crime, putting the person on the sex offenders registry. Given there are men on the registry for having consensual sex or for urinating in public, I don’t think this is at all out of line.

I belief this should apply regardless of the sexes involved.

It's tricky because rape is hard to prove, so there are real cases of victims not being believed. I don't believe the feminists are making that up. After likely having their character assassinated on the stand and watching their abusers walking free, to then hit them with prison time for "making a false allegation" is just too cruel.

That's why I think "false allegations" are too broad of a thing to police. What should be criminalized is "malicious false accusation." Not only does an accuser need to be proven wrong, but the prosecution should have to prove an intent to cause harm or otherwise gain benefit from making a false accusation. It's sort of like the distinction between murder and manslaughter. Intent and premediation should all factor in.

So "false allegations" no penalty, not a crime. Benefit of the doubt.

"Malicious false allegations," definitely a crime that should receive jail time. It shouldn't be a slap on the wrist, but I also don't think a super severe sentence is warranted, maybe somewhere in the ballpark of 1-5 years?

How would one go about it. For 2 years, I've been accused of being on drugs, CPS, COURTS, my reputation was and business was hurt. After 6-8 month nail bed test, hair folical, all came back clean, I was then accused of having someone else take the test. Now the court has take my custodial right and given to her......it just seems like us as men are expected to just go away quietly but pay that money

Had this happen to me. False rape allegations reported one year later after our relationship ended when I ended it. Lied to police and said she felt pressured to be in the relationship for one year after our first night together after purely consensual sex lol. Can’t make this shit up. No charges were filed against me after review from a prosecutor because I had text messsages from her the next day that literally said, “You fucked me so good!”. When can I come over again? “I can’t believe I held out this long.” Fucked up part is that I reported her for making false accusations to a public servant with the city police department that took the original report and they said they will not seek charges against anybody that claims they were raped, even in this case when I have damning evidence that suggest/proves she’s lying. They asked me do you have any messages from her saying that she lied about it. Because that would be the only case that they would file charges against her if I had that proof of her acknowledging that she lied about it. No Justice

Quick story. My ex left me for another man in 2018 . For the second time. It didn't work out. But this time I stopped chasing and moved on. I became relatively successful. My ex on the other hand was crashing and burning. When she discovered my success she got angry. She wanted to burn me to the ground with her. In an attempt to get full custody, she went to the police, have a huge statement, and basically framed me for a crime

But by this time I already paid lawyers, was in jail, and other things happened.

In the end my ex was given a warning. She wasn't charged.

As for me, they dropped SOME (3/4) of the charges. But still went after me for an unrelated charge and my lawyer told me to just take the plea deal and do probation.

If they would of charged my ex for her perjury, she would of been looking up to 14 years in prison

what I learnt about the system is that false accusations literally is the fuel that keeps it going. Punishing false accusers will just lower the fuel amount.

There is a difference between what is fair and what is good. It would be fair to put them the same punishment the man would get plus a big fine. But rape is a very hard thing to prove, and that makes it one of the few crimes you get sentences without more evidence than an accusation (which is bad by itself), so if you put severe punishment to the accusers you would get less confessions of false allegations, and more men will suffer.

This wouldn't be practical, but ideally the way it would work would be something like this;

Take all of the women accusing men and all of the men accusing women and put them on trial at the same time:

Step one is for the female accusers to rank their claims against each other. The accused males should be ranked from most important to punish to least. By the women.

And the male accusers do the same. The accused females should be ranked from most important to punish to least. By the men.

Then, the male accused and female accused ranked number 1 should be given the same, most severe punishment.

A slightly less severe punishment should be given to the male and female ranked number 2.

And so on down the line until both groups of accusers are satisfied that enough people have been punished.

If one group of accusers outnumbers the accused of their own gender, and they are not satisfied that enough people have been punished when they run out of accused, then the remaining punishments for their side should be assigned beginning with the lowest ranked accuser.

Doing it this way, 1) everyone is incentivized to respect the boundaries of opposite gender to the best of their ability, 2) everyone is incentivized to create boundaries as sparingly as possible, and to make accusations only when truly needed. And 3) the odds of being punished by the system are equal regardless of your gender.
