The complaint states that she was so intoxicated to be incapacitated (aka she was passing in and out of consciousness). Including that she was a virgin just bolsters the claim that this was non-consensual. Whether that will be admissible at trial I do not know.

You're focusing on the "virgin" part instead of the "Mr. Hayne used her level of intoxication and his physical stature to deprive her of the ability to make a personal decision about whether or not she wanted to have sex" part.

The virgin thing is just lawyers being lawyers trying out a possible avenue of defense.

In addition, you've admitted you didn't actually read the filing, just this snippet. The full filing provides a lot of context that's missing in your OP.

It's a civil lawsuit claiming negligent infliction of emotional distress, he's using that kind of language to convey that.

It doesn't sound to me like they are using "she's a virgin" as a defense. It sounds much more like "This large man coerced an intoxicated, smaller woman into having sex she really didn't want to have."

Though the "impressionable" part they're playing up is a little condescending to women everywhere.

its not like there's a pre-existing "impressionable virgin" standard, but civil law usually tries to protect people who suffer torts, or are taken advantage of in unconscionably unequal positions

her supposed intoxication ideally would be enough to support this but as a plaintiff you gotta cast as wide a net as reasonably possible, her being a virgin makes her a more sympathetic character and maybe gives a bit more evidence that she would not have consented to intercourse. if you were the lawyer you'd throw it in too.

oh, the "should" game. i will read the article shortly, but i assume this isn't their main argument and is simply supplementary efforts by the prosecution to win their case because that's what lawyers do.

it's lawyers doing what they do; it's not just something that happens to women. brock turner's athletic and educational track record was brought up as part of his defense; it happens.

If having been a virgin bolsters her case then it's fair game. But whether she was a virgin or not, rape is wrong and dragging a near passed out woman back to your apartment and forcing yourself on her is wrong. But rape is a difficult crime to prove, so a civil suit is a way for her get SOME kind of compensation without bringing in felony charges.

Absolutely fucking not. It's embarrassing to see a court authority taking this charge to trial and that goes double for trying to slip this argument in under the nose of a judge as anything worthy of generating precedent.

Western jurisprudence really has not let go of the idea that women ought to be treated differently under the law than men, and this is just a reminder.

I’m not sure what the connection is. The main factor here is that she was so drunk she only has glimpses of memories from that night. I imagine mentioning her virginity has to do with the extent of the injuries she sustained, seeing as she’s still in pain months later. I can’t even imagine being raped having never had sex before, the pain must be indescribable. All in all, this is pretty much the worst example you could use to lead into a question about whether virgin girls are easier to sleep with.
