I thinks it's more of an anyone pass. First offenders should always get one chance before being written off. It also mentions she was under the influence during the video. I'm wasting my breath here

In our court we have an Intervention in lieu of Conviction program, which is what this sounds like. Essentially, first time offenders have an opportunity to get help with their addiction instead of having their case go to trial. The trade off is that the offender has to plead guilty to get into the program. If you successfully complete the program, and most do, that guilty plea is torn up and your whole case dismissed. If you do not complete the program- well you already entered a guilty plea.

It's not quite that simple. She has 3 choices.

  • Not pay bail and stay in jail
  • Come up with $10,000 cash, which will be returned to her when she comes back to court
  • She gets a bond, and pays 10% of the bail to the bondsman that does not get returned.

I kind of doubt that she has $10k laying around so her options are stay in jail or lose $1,000 without any possibility of getting it back.

He assigned someone a bail of their entire annual income. How can you take that seriously? If she's in a group sentencing situation then she's a nonviolent offender, and if he's assigning $10k bail to a nonviolent offender he shouldn't be holding a gavel.

Right, I've seen it before. It's old as fuck. I know she's a disrespectful little shit. But by locking her up nobody's solving anything, it's punishment for the sake of punishment. It's vindictive. It hurts society. She's not going to learn anything by going to jail, other than that she doesn't matter to the legal system and therefore the legal system shouldn't matter to her.

I cringe when I watch the video. I cringe when I see the gif. Not because a literal child is behaving in a way she's probably never been told not to, but because someone in charge of a court of justice is being petty and vengeful. Court isn't personal, and assigning punishments because you don't like someone or are mad is unethical, and not unethical like "you probably shouldn't do this" unethical, more like "the fabric and structure of society shudders immediately in response" unethical. It's a thorough and fundamental violation of the very most rigid structures that keep the legal system running, and it's indicative of a mode of thinking on his part that should be eradicated by any means necessary. Putting someone in prison because they were mean to you is abuse of the justice system, plain and simple.

that is correct. The bondsman puts up the full amount, and you pay him 10% for doing so. That's why bounty hunters are a thing - if you don't show up to court, they don't get their money back.
