Toronto Police threatened to arrest me for pursuing a Regulatory complaint against health professional. The Detective advised me to withdraw the complaint and informed the Regulatory Body that the complaint was vexatious.

The police can't do shit. They don't have probable cause. So for them to arrest you they'd need a warrant issued by a judge. You aren't harassing a healthcare provider because you aren't communicating with them. You're communicating with the regulatory body. Propose to your lawyer to write a cease and desist letter to the police department, mentioning they are intimidating a victim of malpractice.

Sounds like this cop might have a personal connection to the subject of your complaint. Above and beyond like this isn't typically the Toronto Police Services thing, no matter who is involved in any given matter. What evidence did the officer draw his conclusions from?

Furthermore, you have an absolute right to launch a complaint, wherever reasonable, against a federally regulated worker. In other words, if you were using it as a means to harass, libel or slander someone, you could get in a great deal of trouble. However the bar is quite high in those cases and it has to be shown that you acted in bad faith.

I hate to say it, but I doubt there's much of a case here for say, small claims court to recoup your costs (though you should absolutely consult a suitable lawyer on this. Most initial consultations are free in Canada). However, you should make copies of your communications and, as long as you know your ass is in the clear and you have done nothing that could be construed negatively against you, lodge a complaint with the regulatory and/or watchdog groups concerned with police corruption in Canada.

A professional body would do it's own job of reviewing it's own members. I'm an accountant and if someone put in a complaint against me and the police got involved with what is effectively 'their opinion' they will be told in no uncertain terms to FO.

Most lawyers are going to tell you that you aren't in the wrong then collect a retainer.

If there were any evidence of threats, sexual assault, hate speech, harassment you'd have already been arrested. Canada isn't a place where you decide to press charges or not. Once an allegation is made, it is you vs the Crown. This woman can't say "tell him to back off or charge him". The accusation gets made, then thats it. It is hour of her hands.

TPS isn't your friend, or anyone's friend. These are the same people that used 40 cops to shut down a bbq joint that was letting people eat during pandemic 2 blocks from a Costco that was at full capacity and also serving in their restaurant.

If you have evidence of what you claim, then continue with what you are doing. If everything is he said / she said, then give up. She said wins, especially if she is a professional and you aren't.

Does she have any evidence to back up her claims of harassment? If so, let it go and get on that bus. You aren't going to find a place with a different police culture though.

There is not enough information here for random people on the internet to advise you.

1) there's a big difference between an ER doctor or nurse dating someone they treated and a psychiatrist dating a patient. If this case is the former then you should stop the formal complaint.

If it is the latter, please don't give up. I think you should go to citytv or the CBC if the college of physicians and surgeons doesn't help.

If it's the latter you can probably sue the psychiatrist and recover your losses. In this case the doctor should also be suspended or have their license revoked.

Why are the police being involved at all?!

If I were you, I'd be wondering if the detective is a friend or family member of the health professional, and is trying to get the case against them dropped.

This is an extremely serious allegation, which you would need to discuss with your legal advisor.

I am not a legal professional, nor do I live in Canada, but in most, if not all western countries, each and every regulatory body has a complaints department.

Complaints are dealt within a set number of days. If they are complex or particularly serious, they would send out a holding letter within that period, explaining the current state of play.

A vexatious complaint is relatively rare. It revolves around malicious intent by the complainant, or repeatedly writing complaints letters after the complaint has been thoroughly dealt with, and/ or passed to tribunal and been dealt with etc etc. The bar for vexatious complaint is set very high.

In other words, you have to be pretty persistently vexatious to be considered a vexatious complainant!

I have NEVER heard of a police officer, let alone a detective, being sent to visit a complainant in person for a vexatious complaint.

Basically, both you and your legal representative would have received formal letters from the regulatory body informing you of the final decision.

That decision would not rest in any way, shape or form with the police.

The only possible exception would be if threats were made against the person or organisation by the complainant, or if there were complaints made about the complainant stalking or being abusive etc.

Your legal representative would not have taken on a vexatious case, and would have been able to advise you on how to formally contact the organisation in the appropriate way.

I wonder if there is a record of this detectives ' visit, or how he got your address? Your details can generally only be accessed if there is a genuine business need.
