MoCo Resident here. First thanks for the heads up on the ladies night / jello wrestling event. Hopefully there will be a round 3 as I will be out of town next week.

I'm not sure if the case you are referencing is all that relevant. Basically this wasn't a ladies night promotion so much as it was a "skirt and gown" promotion. So a man could have worn a gown and gotten the discount.

However, the court decided that no typical man would have a skirt or gown in his wardrobe and would have to incur an additional cost (buying a skirt) to receive the discount. So the promotion was ultimately found to be discriminatory.

However, this was only found to be the case in Montgomery county where you can't balance a "legitimate business need" with the potential for discrimination. It looks like it may not have violated state or us laws.

I would think feminists would be against lady's night, seeing as how it promotes getting women drunk and how they constantly bring up rape culture.

Found another version of it last night at Union Jacks in Columbia. They were charging men a cover, but women got in for free. Remember, WHY they do this isn't the point. Its the fact they discriminate based on gender. If it was race-based discrimination they wouldn't be able to get away with it. Since its men though its just stays quo or something for us to put up with it. Because. You know, pussy. I guess. Horray equality! /s

Bars get more people if there are more women inside, it's not so much discrimination as it is business.

To encourage more women to go so there isn't as much of a gender imbalance in the number of customers, i.e. so there isn't a room full of men wondering where all the ladies at, which men would also eventually stop showing up if there wasn't a chance of finding women. Price discrimination happens in a lot of contexts, wherever a seller can get away with it and it makes the most sense economically.

I'm not sure how I feel about this, although cuteman's post does ring true.

Please stop comparing a policy like this to discrimination based on race. It is similarly arbitrary, but a ladies discount for drinks is not denying service to anyone. Comparing on race comes off as having a complete lack of perspective.

There are 2 cases that I am aware of, in NY and FL. The NY case was thrown out in federal appeals court as judges said private establishments can charge whatever they like to anyone. The FL case I believe ended with the club having to offer free admission for men as well. I can't find the case off hand but if I do, I'll edit it in.

Obviously, this will depend on your state. While it doesn't affect me, as I don't frequent bars often, as a former bartender I really don't understand the rationale for this. When managers/club owners would do this, women would come in, get their free shot/drink, and promptly leave and go to the next club. In my downtown district, if you are a woman, it is entirely possible to have 10-12 drinks, and never pay a dime all night.

If this gets you upset, I think you should re-examine your priorities. You shouldn't be buying drinks for women anyways. Its not going to make them want to date you. Same principle as the clubs; they'll take your free drink and promptly go to someone else who is more fun. If being charged cover gets you upset, then take your business elsewhere, to an establishment that doesn't promote sexist policies.

This is so when you go to the club it won't be all dudes humping each other and bumping asses on the dance floor.

Do you want a favorable female to male ratio in the club? Then shut up.

EDIT: Ok, guys... listen up. They're not going to give men free drinks. And if they don't give women free drinks, women won't go to bars, unless we bring them, and pay for them.

So, unless you'd like to pay for your drinks and their drinks, instead of just yours, leave this one be. It's beneficial for everyone that way.*

It's allowed because when women get in free/get free X, more women show up. When more women show up, more men show up. The business gets more money with this very simple tactic.
