Some (not me) may argue that such an extreme course of action being taken by the victim is unnecessary and vengeful, as it causes irreversible damage to the attacker.

e.g., if someone punches me in the face, I'm not allowed to chop off their arm in retaliation or to prevent them from punching me again.

Self defence is reasonable force sufficient to stop the attack. If biting a person's penis is the only reasonable option that you have, then it is justifiable as self defence.

Depending on the state. There are some states/districts that say if you can run away you have the obligation to run away. Also, if you need to defend yourself you have an obligation to use as little force as possible.

Like I said, self defence. If he was trying to force himself onto her (given that the rape attempt actually happened) she could've taken the chance when her head was near his dick. You can't blame her for doing everything in her power to defend herself. If she bit him after he was no longer a threat however, that's another story.

In case of her biting him after he was no longer a threat, yes, and should probably be deserving of some measure of legal punishment.

Maybe I should have worded my question better. Say a victim bites their attacker during the attack. But, if they could have gotten away without biting him, should they be charged with something?

What if the victim knew with certainty that their life was not at risk, and they still chose to inflict irreparable harm onto their attacker?

You never know with certainty that your life isn't at risk when you're being attacked by someone. I'll venture to say that if someone attacks me or invades my home, I will automatically assume their intent is to kill me and will react accordingly. You have forfeited any benefit of any doubt.

Ah I see. Such assumptions don't apply to crimes like rape, especially when it's a man on woman rape. If a woman has a man pinning her down (this edge scenario is a must) with his penis exposed, which means he's about to penetrate her, there's nothing that guarantees to her that she could get away without any drastic measures nor does anything guarantee that he won't kill her afterwards. ie. It's not like a slap in the face would make him back off and snapping off a woman's neck or choking her to death is very easy.

Thus in this extreme case, a woman can never know for sure the outcome of the conflict and is justified to use all forms of necessary violence to ensure her safety.

However let's imagine one more scenario where the man is drunk and is making sexually suggestive remarks to the woman. She may feel threatened, and may even label this as "rape" but in this case the man is:

  1. Not actually raping her. So her suing for rape and tarnishing his reputation is a criminal offence.

  2. Not physically attacking her so her life isn't in jeopardy in which case if she bites his penis off, it's also a criminal offence and is worth legal punishment.

NAL, but IMO the self defense cannot exceed the potential harm. It doesn't have to be the minimum needed to stop the crime, because that put the self defender in a dilemma that they should not be in.

Just because their life is not at risk, does not mean that they cannot be irreparably harmed (e.g. being raped). So if the attacker intends to rape, biting their d*ck off seems non-excessive.

Dude, in the scale of proportional force, rape is one of the strongest shows of force, comparable to murder. I don't think there is anywhere in the western world where killing a rapist in self defense would go condemned, much less just maiming the attacker.

If it's confirmed that they were a rapist, then he should be prosecuted as he would in any other instance, and the victim should be free to go.

In my opinion, the victims actions were a matter of self defense. As far as the rapist is concerned, I don't believe they can receive "too much" punishment, so the normal sentence in addition to losing their penis seems just. Additionally, as with any violent criminal, they knew they were taking a risk when they chose to commit the crime. The fact that they suffered the consequence of their own actions isn't something the victim should be punished for.

If the attack was already stopped and then it happened, that's a different story and both should be charged.

Well firstly lets just re-write that headline.

Man gets penis bitten off during alleged attempted rape.

Secondly, the court should proceed in the usual manner, with zealous advocacy against the male first to demonstrate that what he did, in fact constituted a rape, and then if it did not, zealously pursue the woman.

In order for her to have committed a crime against the man, he must have been committing one against her.

What seems most obvious to any casually aware person is that, nobody DARES bite the private parts of somebody who has a genuine threat of violence against them.

If it was rape, then the bite was justified. The real question is whether or not it was rape. It’s possible that a crazy person bit a guy’s penis and then decided to call it rape. As others have said, both are innocent until proven guilty.

If it really was rape, you’d have to be an idiot to rape by forcing oral sex on someone, since it leaves you vulnerable to just this sort of attack.

Rape has a lot of irreversible damage as well you just can't see it, we are assuming this is happened exactly the way it's been put forth as well. But definitely if my daughters or my wife were to be raped by somebody and they had opportunity to bite his dick off I hope like hell they did.

I'm just trying to see what people's opinions on the matter are here, as I recently came across a discussion in which the overall consensus was that a victim does not have the right to inflict irreparable physical harm onto their attacker in such a vengeful manner. Especially if they had other options of deterring the attack.

Fair enough. In the article I posted though, the victim was male. I purposely chose to avoid posting an article with a female victim to avoid a potential bias, although it probably didn't matter since most people appear to not have read the article.

I suppose you could only argue self defense on behalf of the woman if and only if it could be conclusively proven without a doubt that he raped her. I don't believe sexual assault would justify this. Without the context of rape I'd say this would be bodily mutilation and qualifies for the sentencing according to such. So if he was found guilty of rape, not sexual assault, then it is just. If he is not found guilty of rape, charge her with the appropriate offense and sentence her accordingly

Most us states say self defense is only justified because of life or limb. So it would technically be on the victim to prove otherwise, seeing how self defense and gun laws typically go

In England and Wales, this legally constitutes rape. Non consensual penetration of the penis into the mouth, vagina or anus of another person is rape.

I wonder how trustworthy this news is. But if it were the case, no sane man would put his wiener in a mouth of a woman that is threatened. The very position is a very weak for the man. I doubt it happened without consent. I think the woman just claims it was forced to justify her action to bite.

No. I have an actual diagnosis. I am however not willing to share it, because its a confidential document. Dismissing me and not seeing that you were at fault for calling me out is just not okay.
Look. I read the stuff and I don't know who they refer to. If you straight say: "A man bit another man in the dick to avoid getting raped" that would've been clear. But instead, they make their sentence too confusing.

That happens all the time in sexual assault cases. And rapists aren’t sane. He’s not in a weak position if he’s holding a knife to your throat or a gun to your head. If you bite he could react by cutting your throat. He’d still have time to punch you in the head a few times to get you away. And I doubt there are many people that have the wherewithal to bite off somebody’s penis. Bite it off is a glib response to something that would be very hard to do in real life . Do you think if a person isn’t willing to risk a smashed face or maybe even death that means they really wanted it?

Maybe the rapist was way bigger and stronger than him. Maybe the victim is a guy that doesn’t know how to fight and knew he couldn’t stop it with his fists. He had to take whatever chance he had to get away because who knows what going to happen next? Maybe he was going to die there. You’re not all big he-men , you know. And why would a person agree to stick some guys dick in their mouth just so they could bite it? That doesn’t make sense.

I mean if he was actually trying to rape and there's video or other evidence then he deserves to lose his dick.

But if it's found that there is no evidence, or evidence to the contrary then the dick muncher should face charges. If I lost my dick I would honestly delete myself (in Minecraft) and nobody could stop me, so for a punishment that severe we gotta make sure they actually did it.

Sounds like self-defense to me, if the attempted rape was legitimate and not a false accusation.

I suppose a lot of it would come down to any prior convictions for sexual crimes and/or character witnesses.
