I was in a similar situation, the cow filed a false DV just to gain control of the kids and have me removed from my pre marital home which I owned for years before I met the snake. You will get your house back after your divorce is finalized as I did and I became primary parent due to her corrupt improper actions and parental alienation tactics. The custody experts and the courts hate that nonsense from stupid women. I hope you have excellent men's rights attorneys who will demolish the other attorney and their client, meaning your soon to be ex garbage. Who did the appraisal and submitted it to the court? Someone her attorney recommended I'd guess? Have your own attorney hire a legitimate appraiser for you as you have that legal right to object and get a second opinion. If it turns out she and her attorney did something wrong and you can prove it, she's in deep trouble, so is her attorney.

It is unusual and maybe something in your state, but premarital property value does not mean anything. The most she should be entitled to, is half of the principal reduction from the time of marriage to divorce. I would get another lawyer or tell him this. A lot of lawyers don't know this.

Don't settle until you get this settled.

Thanks for all the replies. I had to file a motion to allow an appraiser in the house . Still no word from the judge . I filed that motion before I had proof of the fraud. The signature on the insurance form is my current girlfriends ex . My ex found her ex to date. My attorney is very good. She has two attorneys . Yes only half of of the money from the marriage. I even paid for a passive growth analysis both for my 401k and my home . That’s why I need the appraisal done . I have an appraiser. I sent him a copy of what she had done. They submitted a for loan use only form . It didn’t have any of my bank’s information. They got many aspects of my house wrong. Even saying I had a sump pump and a concrete driveway. Missed the 2nd furnace and the crawlspace . Added a dishwasher when I don’t have one .

I had something similar . I used money that I had before we were married to put down in the house . She used to say my money was mine but she wanted half . She wanted to buy me out and against the advice of friends I let her because it was the joke our son grew up in. She knows people in real estate and got a bullshit appraisal . I had to pay for a legit one and it came in over 30K more . So the investment was well worth it . They are snakes , don’t trust a thing they do but make them think you do

At trial the Appraisal was not submitted as evidence. Meaning we can’t discuss it . Because it was used to try and settle it . Opposing counsel said instead they intend to force the sale of my home . I informed the department of commerce enforcement division of how the scam played out . Trial is not done we need another date. But the state has started to do their investigation. Also the house has been abandoned and I’m missing over 20k worth of items. I secured the property and was threatened with charges since she still has exclusive use .

Get your own appraisal, my ex submitted one from years ago in a totally different housing market than we are seeing now. I paid to have a new one done, and shockingly, it was 50k+ higher than hers.

Fun fact, I was actually allowed to do my own appraisal in CA!

My ex got an appraisal that was much higher than I felt the home was worth (I was trying to buy her out and the market was in a steep decline). In court, my lawyer argued that my ex was cozy with the appraiser and he raised the price at her request (we had both appraisals).

I gave my own estimate without an appraiser (based on current listing prices). Her lawyer balked, "He can't provide his own appraisal!" My lawyer fired back, "According to California law, the owner of property is allowed to estimate its value." That shut her up and the price was dropped substantially.
