We are still married just separated havent filed yet. STBX made around 90k last year and starting this year will be making right at 100k with a new company. She is a computer software engineer. I generally make in the 45-48k range as a self employed mechanic after write offs. (its only been the last 6 or 7 years of our 23 year marriage that she has gradually out earned me). Year and a half ago i had a injury/surgery that put me out of work since June if 21. Last year i have a loss for filing taxes.
Anyhow she wants to file married filing jointly for obvious reasons. Doing so we will get back around $5200 (she pays a lot extra in every year to cover most of what my business would normally accrue in taxes) $4300 of the return would be what we would get back before adding in my business losses. Adding in my business losses brings it up to the $5200 amount. However she wants to keep 100% of the return for herself and not give me any of it since i didnt work all of last year due to my injury and complications from it. So i told her to pound sand and she can file as married filing separately and i would do the same. Her doing so she would owe another $2000 approximately but i wouldnt owe anything as i show a loss for last year since i was out of work. So now she wants to just give me the $900 difference my deductions would make so she can still file jointly and get the refund rather than having to pay in another 2 grand. I am personally thinking screw the $900 she wants to give me and make her file married filing separate.
